Hey guys,
I will try and send my AOS and EAD at the beginning of the next week. I have been stamped with a temporary EAD at JFK so from what I understand I'm allowed to work until January 20th. My internship starts on January 7th and by the time my I-94 expires I will still be waiting for EAD (if it indeed takes 3 months). What do I do?????????????

Legally you cant be employed while you do not have an EAD. You may be able to get around it though, make sure your employer knows when the EAD expires, and show them the receipt notice for the EAD card.

Infopass, maybe?

Also internship can vary by profession, but if you have an internship that is affliated with a school program or that is unpaid, you can probably negotiate your start date if that becomes an issue.

the problem is that it's accounting and that it IS paid

Once your temp EAD expires you are no longer authorized to work.... you will not be authorized again until you have been approved for the EAD you filed for along with your AOS.... showing the receipt notice will not work it is not one of the accepted documents on the I-9 form that your employer is required to have you complete...

It really will be down to your employer whether they will let you continue to work after expiry or not as it is your employer who will be in trouble not you.... unauthorized work is forgiven at AOS interview if you are married to a USC and are approved for AOS....

What about an extension? I don't know if it exists..maybe at Infopass they can answer.

The I-94 can not be extended this is the reason that most K1's dont bother with the temp EAD as it is only good for 90 days...

Odds are about 99.9% you will wait 90 days for your EAD after you file the package.

So if you file early next week, you should expect the EAD around the end of February or early March.

If you continue working during that time, the employment is unauthorized. Your employer could be subjected to fines should your working there be discovered. Not a good way to get off on the right foot at a job, eh?

What ever way you look at this you are going to have a gap in your employment authorisation. If I were you I'd be honest about this and have a chat with your employers. Maybe you could work up until your I-94 runs out and then take a hiatus until your EAD comes through?

Can I just talk to him to take me off the payroll so I could still be in training but if I'm doing it sort of voluntarily? Like an unpaid internship? That is not unauthorized employment is it?

If it is a job where someone would normally be paid then it would still be classed as employment even if you were not being paid....

Thank you hun. I'm going to send you pics from my moldovan and US wedding a little later smile.gif Trying to file for AOS and study for DL written test...I hate being busy
