Full Version: Will getting a divorce effect citizenship

Everyone pretty much knows my situation...

We are getting divorced. This is a decision we both made together. She would like to stay here in the states and I do not want her to be forced to go back to Russia. How will this divorce effect her becoming a US citizen? If at all. She is continuing her education and if she needs loans, I want her to be able to do what she can on her own. I am helping her out for the time being with trying to get on her own feet. I want her to have a good life because she deserves it as do I. It just didn't work out with us together.

If green-card is conditional one, the green-card holder can file a waiver and remove the conditions on the card.

Citizenship cannot be applied for until 5 years of residency not 3 years.

Prenup aside, you are responsible for her until she earns 40 quarters of SS credits. Remember the support agreement you signed and that you are going to be held accountable for her. Are you sure you want to risk that?

If she is enrolled and taking classes at a college or university, is there some way she can apply for a B-1 visa and stay in the US while it is processed and possibly approved? I dunno, just throwing that out there, I'm not expert in this stuff, by any stretch of the imagination.

olgarobert, I read your topics about this. Sorry to hear you are getting a divorce. But you were married for 3 years, do you still think she used you for a green card? Seems like you guys should have got counseling or something. Oh well, I guess sometimes it happens. Good luck.

B-1 is a business visa and doesn't allow one to enroll in college.

She has a green card. Why in the world would she need a visa? If she needs to remove conditions, she can do so by self filing after the divorce.
