I just realized something......I am getting married on December 28th..... my finance's k-1 expires 1/3/08. we will be on our honey moon until 1/8/08. her only form of id is her Russian international passport.... will she be able to fly back to California from Hawaii with her Russian passport even though the k-1 is expired????

Yes Last I knew Hawaii was the 50th state, and flights from there are Domestic. There is no POE or Customs inspecting passports on domestic flights.

Passport is only used as photo ID on domestic flights.

Note: K-1 is voided the moment it is used. I-94 can be expired because domestic travel does not require it.

That's not entirely accurate. Hawaii (and Alaska, Puerto Rico, Guam, U.S.V.I., etc.) has special rules and you should double check with the airline and Customs before you go. However, once she's your wife, she has every right to stay in the U.S., but she has to be in the U.S. in the first place.

AKDiver flew to HI with his wife and they had no troubles. Maybe you could PM him to see what they did. I don't think there are any serious issues, and even if there are, what are they going to do, send her back to Hawaii?


Quick Edit: Until she gets another form of ID (like a GC, EAD, State ID, etc.) she should use her international passport and a notarized copy of your marriage certificate as her ID. Ensure she carries the marriage cert. with her passport as this is technically the only thing that legally entitles her to stay in the U.S. once the I-94 expires and until she gets another form of documentation such as a GC.

Humm, you could go to the courthouse and get married 'officially' before your ceremony on the 28th. Then you could use the certificate to get a state issued ID, and she could keep the more important documents at home (the passport and the MC).

I know the passport is acceptable ID when travelling on a domestic flight, but if there are restrictions regarding Hawaii as was suggested, you may want to consider this alternative.

My wife and I got married and went for our honeymoon to Hawaii. We had the same situation as you, we went right after the wedding. The only difference is that my wife had her state ID at the time, but it does not matter in this case. You dont need anything but your own driver's license, and your wife's ID, I am pretty sure passport will do.

In theory, you need no ID whatsoever to travel between the continental US and Hawaii. You will get increased scrunity from TSA at the airport, but that is about it. Convincing the airline that you are who you say you are is the issue - they don't want people using other people's plane tickets. Anything in your name (a hotel reciept for example) is often enough to establish this.

You could charter a plane to HI, or fly yourself. In this case, there is no need to prove your ID to anyone.

We filed AOS paperwork well after the 90 days from entry. (About a year an a half later). As long long as a K-1 is the basis for your AOS and you married within 90 days, there is no time limit to adjust status.

If you don't marry within 90 days, the K-1 is no longer valid, and you must petition an I-130, and upon approval of this, an I-485 AOS. This adds some money in fees and a slight delay.
