Full Version: CR1 visa, can I file I-751

Well to give a little background. I got married in Sydney, AUS and came to US via Direct filling. On my passport it says CR1 visa category.

I am all prepared to file it today, but one of my friends said I751 is for K1 and K2 only.

So am I supposed to file for I-751? or AOS??

Your friend is misinformed, don't listen to any more advise from them.

I-751 is for removing conditions of ALL conditional resident green-card holders, no matter how they entered the country. (K-1, K-1, K-3, K-2, CR-1, and any other visa holder that married a US citizen and adjusted status in the USA)

If you were married for less than 2 years at the time you entered the US and activated your CR1 visa then you MUST file for Removal of Conditions before your 2 year Greencard expires... the earliest you can file is 90 days before the expiry date on the Greencard and and you must have filed by the expiry date.... if you do not do this your CR1 status will be revoked and you will have to leave the US or file for AOS and I-130 all over again...

timeline.gif It helps others when determining things like how long DCF takes for a particular country, and ho long I-751 is taking for the various service centers.
