Full Version: Canadian married to a US citizen moving to USA

Hi all!

If someone can please help, I would appreciate it!

I know a married couple...he's canadian and she's american. They have been living in Canada, but now want to move to the USA. Like I mentioned, they are already married. He doesn't have a visa or greencard. He's 87 years old and does not work and will not be working in the US. Does he need a visa or greencard?

Yes, he is still Immigrating to USA to live here permanently, it needs to be an IR-1 or K-3 visa. The IR-1 can be applied for at the consulate in Canada.

If they have been living in Canada they may be eligible for DCF (Direct Consular Filing) which can be quicker than a K3 or CR1. They should do a little reading to find out if they are eligible.
