Have a friend whose son will be born in Brazil in a few weeks.
Mother is Brazilian. Father is American.
Mother arrived here on K-1 Visa and they got married.
Mother has Green Card.
My question is does the child have to receive a Visa before the Mother and newborn Son can return to the USA?
Thanks
Hi,
I just had a child in Brazil back in August and just returned to the US two weeks ago (My husband is Brazilian and I am American). Here is what I needed for my child to exit Brasil and enter the US.
First, we needed a US passport for the baby to get into the US. This was easy. We just made an appointment with the US Consulate and provided all the documentation they requested (birth certificate, prenatal records, passport form, and a form to register a birth abroad). The US passport came 6 days after the appointment.
We then had to get the baby a Brazilian passport. We just made an appointment on their website. Be sure to get an authorization form, which both mother and father need to sign for their consent to getting the passport.
Also, if the mother and baby are traveling without the father, my child and I needed written consent from her father to leave Brasil. This consent has to have the federal police stamp on it. We were able to obtain this form at the federal police station inside the airport. However, both my husband and I had to be present. But, I think if the father is in the US, he can send this document to a Brazilian consulate for approval.
Sure do hope this helps.
Best of luck to your friend and the new baby.
