apparently, if you live with your spouse in belgium for 6 months, you get some kind of express filing

is this direct consular filing? wasn't that only for people who are married and abroad for 2+ years?

You can direct file if you meet the residency requirement for the country you are living in. The length of time to meet this criteria does vary by country (6 months for the UK).

If this person is direct filing, they are going the CR1/IR1 route because K3 is not possible. I think that's where the confusion arose smile.gif

If this person thinks it takes 6 -8 weeks to get a visa they are sadly misinformed.

I have seen these sorts of posts pop up occasionally on various sites. I have yet to see anyone with visa in hand in such a short amount of time. About the quickest K3 adjudication I have seen from submission to approval notice was around 50 days, but then it still took about another 4 months or so to process through the consular. We all know the steps involved in this process and just with postage alone to the various places will take weeks of time, let alone the adjudication of the case at both the US and consular levels.

Let this person believe that their case will be done in 6 weeks, you wont be able to tell them otherwise until the timeframe passes and they start posting the why is it taking so long when we were told....yudda yudda yudda. It does not matter what country the person is from. All cases are accepted on a first come first serve basis. ALL.

ahhh now if they are doing DCF, thats a different kettle of fish.

Yep, that's direct consular filing. It's not really "express filing". It's just that overseas the I-130 approval process is much faster because each consulate is dealing with so much less than the US service centers.

Your IM buddy was confused - it must have been the I-130 (there is no I-150) and it was a CR1 or IR1 visa, definitely not K3 visa.

It is true that after a USC has been living in Belgium for 6 months on a residency visa, they could file the I-130 directly with the consulate. Six to eights is incredibly fast, and I can only imagine it's that they don't handle very many - not the stuff your IM buddy was saying abou the EU. That's kind of weird. In London, the process is more like six months, which is still faster, but not crazy fast.

If you lived in Brazil on a resident-type visa for six months, you could also file directly at the consulate in Brazil and have a much quicker process than you are currently experiencing.

My husband lived here in brazil using a tourist visa for 6 months, are you saying we could have used DCF?

If so, is there a way to still try that even though we're already processing k-3? Or is it even woth it, considering our timeline?

"Living" there on a tourist visa will not allow you to DCF. It must be a resident type visa.
