My husband came to the US on a K3 visa on October 31, 2007. I am wanting to know if we can still file for only the EAD at this time so that he can get to work as soon as possible, and file for the AOS at a later date, or do they have to be filed together with the new fees for the paperwork in effect?

yes you can.
file the I-765 using (A)(9) filing code. this will give you a EAD that is current for the life of your visa.
cost $340.

You can but when you file the AOS later, you're essentially paying for EAD again, as the new fee includes EAD.

Hi Tammy,
I thought your I-130 was approved and your husband came on it. If he came with approved I-130, he can just apply for a social security card and start working. With the I-130, the AOS should have already been reviewed and approved prior to his interview. Did he really come on the K3 and not the I130?

Yes, he really came on the K3 visa, the I-130 was approved but he interviewed and got his visa on the I-129. So, we do have to go thru the extra work of applying for the EAD. I know it's a hassle, but at least he is here! LOL I wasn't sure with the change in fees if there was also a change in being able to apply for only the EAD at this time and the AOS at a later date. Now that I know, I feel much better. With the holidays coming up I was starting to get worried that there wouldn't be any money for Christmas Shopping. LOL
