"May take" -- but since they are clearly processing I-130s filed recently they might want to explain to anyone with an October receipt date (or earlier) why this is the case. They should NOT be working on a case filed after if they are allegedly doing them in order. Unless a case is expedited, it shouldn't be processed except for when all previous cases have been dealt with in some manner -- processed and moved on or an RFE is put into place and the case waits for the petitioner to act.

They are clearly not using the receipt date. At best, they're using the NOA date. And even then, it isn't right!!

ok.. i havent received my hardcopy NOA2 yest.. it says it was sent april 19 07.. i think it should be ariving today or tom.. and also i caled NVC first time yest in evenin and it said all operators r busy? and i hung up did i do the right thing.. i was callin to inquire ifmy case reached NVC.. how do i know LOL NVC is all new to me now..

do i call uscis or NVC to see if my case reached and how do i know when i have a case numbeR?

Your NOA2 hard copy will arrive today. Don't call NVC operator unless otherwise required. Just dial that 603#, press so many 1's until to enter your I-130 receipt#. Then hear the message. To get 603# is little difficult, but if you do redial 3 to 10 times at the same time, it will be connected

To see if your case reached NVC call 603.334.0700...then press 1.1.1.1 then put in your cis case #...then if they received your case you will get your nvc case#...

The ombudsman's transcript is interesting. It says the date is for receipting, not processing. But USCIS clearly states that these are the dates they are just comleting, not processing. (Per http://www.uscis.gov/portal/site/uscis/men...0000ecd190aRCRD )

So I don't find the ombudsman's report to be credible. Further, he's a watchdog, not USCIS. What he says is not in fact, fact.

I don't think quoting him gets us anywhere.

While he is only a watch dog his reports are based off of responses provided from USCIS , the way I see his comment he kind of jumped off of the receipting question and and stated USCIS' processing procedures in general. And it looks like USCIS took that information off of the website so atleast this is information being seen on a government website and they would have to assume some responsibility for what they post. Either way this is the only thing that seems to address this. If we based our information off what was posted on the USCIS website that would mean we are all crazy in thinking that they have any FIFO order. So pretty much no one can say that things are unfair because they never mention anywere else that they use the FIFO system.

Hey, let us know how it turns out. Our timelines are pretty close to each other. VSC received ours on 11/21/07, sent out NOA1 dated 01/25/08, and I see people who filed after us who have received their NOA2 which I do not think is fair.

USCIS doesn't say "FIFO" but FIFO is the equivalent of processing by receipt date which indeed is stated by USCIS.

In that respect, they both agree. FIFO tends to be used in computer circles and not in regular life. So that it doesn't show up on the USCIS site should not be of concern at all. It is geek speak.

Maybe they do say that but we are still unable to provide a link for Shrew that shows that their procedure is to do things based on the date. At one time when there were issues with the delay problem they had on their website stating that they would honor the date recieved and that things would be done on a first in first out baisis, now there is nothing that shows that on the USCIS website

Yeah I was suprise to get my case# so quick...I'm upset though cause I lost two weeks since they rejected my email and I had all the necessary info but NVC was just to lazy to read my email...so this week didn't produce anything for me...hopefully next week I hear something different...you email the DS3032 as soon as you hear the message "The DS3032 Choice of Agent and Address was sent to the Beneficiary on so and so date blah blah blah...once you hear that send the email...

What do you mean? It says they process by receipt date clearly on their page. That it also says it could take as many as 10 months to process is possibly true but irrelevant. Only *if* the previous apps have RFEs does going to someone receipted afterward make ANY sense at all.

Even if they were to honor the actual NOA1 date, we're still screwed because my NOA date is January but people who were received after that have gotten approved.

Bottom line : FIFO is FIFO. Receipt date is receipt date. The date of the NOA is not the receipt date -- the receipt date is clearly stated on the NOA1.

They need to answer about the drunken sailor route they are taking through the applications.

And make sure you put the petitioner name, date of birth and beneficiary name and date of birth, with NVC case# on top before you write the body of the email...that was why mine got rejected I put the date of birth within the body...so since they didn't bother read my email they missed it which is why they rejected it...lazy i tell you... ...At least they are not as bad as USCIS....

remember how I told you that they acted like I might have a RFE and then we decided that was just an automated message?
Well, I get a letter today saying that I dont have an RFE and I was never sent one b/c there isnt one showing up and that my case is still within processing times and they are processing cases up to july 30 and that all I have in my case is my receipt and since I might have "misplaced" it they issued me another one.
so. now I have two NOA1.
it still has my october filing date but now the new receipt is for April 18.
same receipt number.
weird.
so..they have time to do all that but no time to approve me?
so sad.

That is so weird Shrewdie. Well at least you know your application is there and without an RFE. Have you not had any touches lately? I woulda thought that new NOA1 woulda generated a touch.

That's right Shrewdie, we have to be NEXT CSC is way ahead on i-130's, VSC is just screwed up pulling from wherever.. USCIS is not going to change the timelines until they are sure they've cleared every july filer... I bet they were getting into trouble from all sorts cuz ppl were still not getting adjudicated and USCIS's timelines were reflecting dates past those filers. So, to cover their behind.. they just decided to keep the timelines in july and avoid all the hassle from senators.. congressmen, lawyers, etc... and also from us.. they can and still quote the timelines to get us off their back!

May I whine in here too? I am a Nov filer, got touches on 4/23 & 4/24 (probably cuz I called CSC), but nothing after that. My hus and I are so depress and worry. We just love each other and want to live together, why is it so tough? i am a good citizen, pay taxes, don't water my yard during summer, always recycle and a registered voter. Why is US still this harsh to me?

NO NEWS Hyd... I dont know what is up with VSC, but they approved 15 I-130 filers for the whole month of April... in a little over a week I will be at 7 months wait time! I'm so upset Let's see what this week will look like for approvals, i am keeping my fingers crossed.
