I would like to start this thread for those who filed I-130 in October and November. We sent our I-130 on October 1st still didn't get NOA. With all this processing time delays published by USCIS it seems like it is going to take a long long very long time for us to get NOA.

I didn't request no Expedite service.. I also I sent my application via Priority Mail only..

Today I just got my IV Fee Bill of $380.. After paying this, I am going to be on my last step which is the DS230..

I'm sending our K1 Petition tomorrow, hope everything goes smooth for us. I've taken my time reading between the lines and preparing the 1-129F package. So I'd like to keep in touch with November filers!!! kicking.gif

I am just worried that it is going to take so long. I had to go home for two years bz of the J-1 visa and my husband stayed int he U.S. We are separated for 15 months now. And I just hope that I will get an interview in August 2008 when I no longer have to stay here.

You got very lucky what can I say! We are not lucky at all. USCIS stopped processing I-130 it seems like for a while. My husband called California Center they said it is going to take them 15 weeks before they issue NOA1. Very much looking forward to it! I just decided to look for a new job in Russia, since it seems like it is going to take some time before I get my interview. I hate to be pessimistic here, but it is not looking good at all so far with processing delays.

Yes im also considering moving to nicaragua with my wife.
Since i can move there wait 6 months and make the petition directly in the embassy.

My petition was received on November 17th 2007 Stamp by P Novak

Petition appears that would be on the mailroom for quite some months.

I sent my I-130 to the CSC on October 5th and nothing yet. It is sad that they increase the price and decrease the service. You would think that someone would have anticipated more petitions before the fee increase. Well I guess someone is a whole lot richer.

What service center did you apply to? I sent mine to the CSC October 23rd, and haven't gotten anything from them. They are royally screwing me.

No, she is applying for AOS not for CR-1/IR-1... so her process times say nothing about the processing times of I-130s. We sent ours way back in August and not even our check is cashed yet!

I heard of some CSC filers that got their NOA1 but no one from VSC yet. I think the latest one had sent his I-130 around 7/27... since then there has been nothing. Someone said all the further process supposedly will not be affected- but I am not too sure about that.

I kick myself in a butt that we didn't file earlier. I couldn't come back before August 2008 anyway so we tried to time it right. We had a whole year. I was so sure that it won't take longer than a year and that is why we started putting papers in Septemeber and sent in application on October 1st. I regret it so much now. Also I wish I could find this forum earlier and found out more about the process beforehand. A lot of people tried to convince us that we couldn't file before my 2 year home requirement wasn't over. Imagine if I didn't finally figure it out and filed papers next summer? So I quess we should be happy. My big comfort is that it will have to end one day and I will see my hubby again at Denver airport and we won't have to separate ever and ever again. Because everytime we do it is heartbreaking.

The only thing I do feel it is unfair that K-1 petitions are being processed as usual and N-400 are given a priority. And I am sorry for the folks who filed to VSC in August and are still waiting, it must be a torture.

They have processed the back log in a strict order. Employment visas first which they are now up to date on. Then the N-400 naturalisation applications. Finally they will then work on the I-130s. CSC have made pretty good progress on the N-400s and look like they should have caught up by the end of this week. Hopefully next week we will see the first moves on the I-130s.

I think this forum is superb and the post have helped me alot get through the backlog and trying to understand. But I will tend to disagree with you here as there are many of us from August that have not gotten a NOA1 from California or Vermont. Yet there are people getting them from October and November. Sigh the government and keeping peeps confused./

I have seen plenty of K1 visa applicants who have their NOA1s for October and even November. But I haven't seem anyone - particularly from Vermont SC - who is applying for CR1 who has their NOA1 from Oct, or even Sept/Aug. Happy to hear from anyone who has.

I filed both, nothing on either from end of August as alot of us, but let me go back and see - what I do see happening is that when the I129 and I130 are filed that yes November filers are getting NOA1's back on their I29's sorry mate, didnt look that close.

I filed both, nothing on either from end of August as alot of us, but let me go back and see - what I do see happening is that when the I129 and I130 are filed that yes November filers are getting NOA1's back on their I29's sorry mate, didnt look that close.


And I can only see two from my timeframe (late August) out of three that have gotten their NOA1 on the K3 - I did not expand my timeframe as that was depressing enough lol - good luck and I guess its just a hit and miss situation.

At least by being married for 2 years you will be on IR-1 visa and won't have to worry about removing conditions down the road. We were lucky to have filed at a time when applications dropped. When we first sent in our app., CSC was running 6 months behind on issuing NOA 2 and suddenly in June we were done with USCIS and the back log had dropped to 3 months. Hopefully, the extra 1500 people they say have been hired will start to speed up your process.

I put together a spreadsheet of all the USCIS processing times that I could find. You will find a link to in on my blog (see link in signature). At least looking at the weekly updates in one place, you can see where the various Service Centers are concentrating their resources. I would think the I-130 NOA-1's should start coming out in force within the next few weeks from both California and Vermont.

Keep your fingers crossed and hope for the best.

I still have not even received a notice of receipt (unless you mean by sending it certified mail..which I did and I also have that receipt) I have heard NOTHING from VSC yet sad.gif

i did just post this in the other room if you read it 2x forgive me i am now to post boards lol


i filed in september as well to bring my indian husband over to the states. 2 months no check isnt cashed! i called uscis, and they passed me onto an immigration officer. could take upto 18 MONTHS TO CASH CHECK!!!!!!

then another 6 months or more to process. it will be over 2 yrs before i see my husband. this is rediculous, this is too slow there has got to be something else that can be done... is there anything anyone know? what if i fly back to india and file from there, i did hear its faster to go through the embassys anyone have any ideas?


and cebu2florida, please let me know when or if yours ever gets cashed , lol i mean if you dont mind, because i filed at the end of september so its possible if yours gets cashed i will be soon behind you... IN THE NEXT 2 YEARS...

I haven't received a NOA yet, so can you please tell me how the USCIS claims to be up to date on this particular form for the NSC? Would you suggest I call them? I don't know what to do and my husband is asking me every day if the NOA has come in the mail yet. Of course, we are both frustrated wacko.gif , but if I had some way of finding out some info, it would help.

Nebraska isn't claiming to be up to date for the I-130s as Nebraska doesn't deal with the I-130s. The I-130s get sent to California to deal with.

As you can see by the USCIS dates California is still processing I-130s to the end of August.

And as posted elsewhere on this site USCIS is now saying that all I-130s from California after August and Vermont after the end of July are going to be sent to Chicago for the initial data processing and that is probably where your NOA1 will come from.

There are many people who filed in AUGUST to Vermont and SEPTEMBER who filed to Nebraska/Texas/California who have not yet had a NOA1 because of the huge delays.

This email received from my lawyer last night....hopefully they have more insight than USCIS or whatever they are called now a days...


Hi Susie:



Yes, USCIS had received close to 1 million applications in July prior to the July 30th fee increase and were not set up to handle the influx of applications prior to the fee increase. They are working through it and we are slowly getting all the receipts in. In many cases we are getting approval notices and no receipt notices due the length of time it is taking. Your case is at the Texas Service Center and may be transferred to the California Service Center depending on the case load, but will not go to Chicago . We will receive either a receipt or approval or both shortly, only we have to be patient while they work out the issues. I would say that your case would only have a month or two delay, if any. I will let you know as soon as I receive anything

I just got off the phone with immigration officer and she told me they forward all Vermont applications to Chicago and it will take at least 60 days before they sort all the things out there.. I think nobody knows what is going on. they just read things from their site. so that is means may be we should trust their site then

That is Encouraging!!! On a brighter note, I am going to Thailand to meet my hubby there for Christmas!!! We haven't seen each other for four months. It is one of few countries where we both can go without getting a visa plus it has nice beaches. What is everybody doing for Christmas?

I filed in last week of october. Filed I-130 and I-129f together and my complete packet was returned to me yesterday. I am very annoyed right now.

I am an October 30 filer. I want to puke!!
I am so frustrated!! What REALLY frustrates me is seeing with the extra filers the VISAs that they decide are important enough to do first..and WE are well down the list!!!

I participated in a State Department program. And so I was on J-1 student visa in the U.S. This student visa requires to come back to a home country for 2 years before you can change your status to anything else. My two years are almost up now.

So, We have been screwed up again. I was supposed to fly to Thailand yesterday to meet my husband in Bangkok. We were going to fly to Phuket for Christmas. Well, I used my passport which was still on my maiden name and the customer officer didn't let me to board the plane. My husband is already in Bangkok and in process of canceling everything we have planned to do and change his tickets to go back to the U.S.
He can't get a Russian visa in Thailand because according to new immigration laws, you can no longer apply for a Russian visa in country you don't reside.

The word of the day - Despondent.

Hello everybody,

We also filed in November. My wife (a USC) mailed I-130 and G-325s to Nebraska Service Center on November 13th. It was received on the 15th according to USPS tracker. But we have heard nothing from USCIS yet.

My wife is from Minnesota. That is why she mailed the petition to Nebraska Service Center. But we have started to panic now! Even the USCIS website does not have processing time up for I130s that are sent to NSC. Can somebody please help me by explaining about WHAT HAPPENS TO THE I-130 MAILED TO NEBRASKA SERVICE CENTER? Your responses would be highly appreciated.

We also filed in November. My wife (a USC) mailed I-130 and G-325s to Nebraska Service Center on November 13th. It was received on the 15th according to USPS tracker. But we have heard nothing from USCIS yet.

My wife is from Minnesota. That is why she mailed the petition to Nebraska Service Center. But we have started to panic now! Even the USCIS website does not have processing time up for I130s that are sent to NSC. Can somebody please help me by explaining about WHAT HAPPENS TO THE I-130 MAILED TO NEBRASKA SERVICE CENTER? Your responses would be highly appreciated.

Don't panic. We have filed in October to Nebraska and we still have nothing. Everybody who filed to Nebraska used to get their petitions transfered to California bz NCS doesn't process I-130s. Because of the millions of petitions filed past July everybody who filed after August 30 in California STILL don't have a NOA1. Latest news are that all petitions filed after August 30 to CSC and July somth to VSC are shipped to Chicago for data entry. So Hopefully in January all of us will hear smth. Look at the August/September I-130 forum and you will learn more. Sorry for breaking bad news to you.

I have to renew mine but dont want to change any names since it will require more paperwork and I am afraid that I will be issued a passport in the name of Jerry Springer or god knows whom - the way our government is screwing up left and right I dont trust anything they do anymore

The tickets matched my passport. It the custom officer who just felt like screwing up smb's life at that particular moment. I went to find out how I can get my passport exhanged yesterday. They have not issued a single passports since October. So chances I get mine soon are zero. Russian plus American bureaucracy equals a NIGHTMARE.

My husand and I are very anxious and worry. I don't know how much longer it would take for them to at least look at our application. NSC does not process I-130s. Your I-130 will be transferred to the Chicago Lockbox for initial data input and then sent to either California or Vermont for processing. USCIS hasn't issued NOA-1s for I-130s dating back to August, so sit back and be patient: it's going to be awhile.

I got papers together to apply for my husband's invitation that will let him to come to Russia for three months. I will do it on Tuesday. So Four months apart down and four more to go.
