Full Version: Is this an 'overstay'?

I have always been under the impression that an overstay was someone that stayed past the issued time on a Visa. Since I am Canadian, I do not require a visa- nor are we part of the VWP. I know that Canadians can visit the US for up 6 months per year.

The last time I visited my husband, I planned to stay for two weeks which is what I told the CBP- I also had a return ticket to show this.Because I was on maternity leave and our daughter was with us, we decided to extend my visit by almost an additional 6 weeks so that we could spend more time together as a family ( 58 days in total).

All my visits in the past year - or 12 rolling months including the 58 days probably do not exceed anymore than 95 days.

So, is an overstay if I visited longer than I thought I would - or is it only an overstay if spent longer than 182 days in the US.

An overstay for a Canadian is staying more than 6 months total in any 12 month period.
