We have sent our I-751 on Oct 18, 2007 by USPS and it was delivered on Oct 20, 2007. As of today, the check has not been cashed. My wife's GC expired tomorrow Nov 9th, she needs the NOA letter to keep her job at the bank. We are very very worry now. Is it normal that they don't deposit the check in almost 3 weeks? I under stand we won't receive a NOA letter unless they deposit the check first. Should I try to contact them or wait for few more days?

Your help will be greatly appreciated.

Victor

Thank you for the reply. It just seems to me that most of people here got their check cashed in 3 days and NOA received in 2 weeks at CSC. We'll just to have find somethings to show her employer that her application has been received and her case is in process.

What you are seeing on the timelines is the date of the NOA1, which is often a couple of days after it is received at the service centre. However, most people are having to wait about a month to get their check cashed and to actually receive the NOA1 in the mail.

Be patient, I am sure it will arrive any day now.

Incidentally, does your wife have a drivers license and an unrestricted Social Security card? If so, she can use those for I-9 verification at work.

Correct, and if you filed the I-751 90 days before card expire, the current card should be fine until you get the letter, it is not taking longer than that for I-751 NOA1.

It was a mistake on my part, I kept thinking her GC expires in Feb next year. It was until her bank/employer contacted her regarding her expiring GC then I realized her GC going to expire on Nov 9th this year. I guess banks are more restrict in making sure all employees have a valid GC.

As I said before, has your wife got a drivers license and an unrestricted ssn? Employers cannot demand to see your green card specifically. They should give you a list of acceptable documents which you can present to prove identity and entitlement to work. Here is the link to the USCIS version: http://www.uscis.gov/files/form/i-9.pdf.

Quote :- Section 3 - Updating and Reverification. Employers must complete Section 3 when updating and/or reverifying the I-9.Employers must reverify employment eligibility of their employees on or before the expiration date recorded in Section 1. Employers CANNOT specify which document(s) they will accept from an employee.

I am always telling my employees who are permanent residents (conditional or not) to make sure they change their restricted ssn card for an unrestricted one. If they do that, they never have to show their green card, but simply have to check the box which says that they are a permanent resident, and present a DL and SSN.

Maybe you never got around to changing her card?

The TSC received my application Oct 16, 2007 and just cashed it yesterday. I hope this helps.

My wife has a valid CA drivers license, but I'm not sure if her SSN is restricted or not. I'll find out later.

Thanks for you help.

Just check the SSN card, if it has "Valid with DHS auth only" if it is a restricted card, go to SSA office and apply fro a replacement one using the conditional green-card, ASAP.

NOTE: any time a person's immigrations status changes, you should visit SSA and record this, it has an effect on benefits that SSA will grant. Even do this after naturalization.
