K-1 SHOULD NOT file I-765 BEFORE filing for AOS.

Filing for EAD before AOS costs $340, and results in an EAD card that expires 90 days after entry on the K-1, it takes about 90 days to get, so you end up with a useless $340 work permit.

File for EAD with AOS using code (c )(9 ) (I-485 pending), this is included in the AOS fee so costs nothing more, and results in a 1 year EAD card.

Only way to guarantee work privileges upon entry is to marry first and then file for an IMMIGRANT CR-1 visa.

After moving to the U.S. with the K-1 Visa, you will need to marry within 90 days, then apply for AOS. Along with AOS, you can apply for EAD and AP. It is all included in the same fee.

You cannot apply for EAD without the AOS.

K-1 can apply for EAD before, but it is an expensive $340 mistake to do so.

Because USCIS takes just short of 90 days to process and send out the card, and it will expire the same date as the I-94 card (90 days from entry)

I have read of many people making that mistake, and getting denied the EAD card due to I-94 expiring before USCIS can mail out the card.

This is explained well in the I-765 guide. http://www.visajourney.com/forums/index.ph...mp;page=k1k3ead

The K-1 is not a work visa, it is a fiancee visa with the solo purpose of allowing a couple to marry in the USA and adjust status.

If you want to work ASAP, as I said an IMMIGRANT CR-1 visa is the better one for this.

One of advantages of a K-1 visa as listed on USCIS website is that I can be employed!!
Im confused!
And if i come in to USA on a K-1 visa,,,why do you mention I-94??

K-1 is a NON-Immigrant visa and like all NON-Immigrant visas, has an I-94 card attached at POE with a 90 day expiration stamped on it, the I-94 card indicates when a marriage is needed to be done or when the stay in country expires if no marriage has taken place.

The K-1 is considered to be "Work authorized" by the Social Security department to allow a person to get SSN, due to a federal law on the books that requires both persons signing on a marriage license to have SSN, some states follow that law to the letter and this gives K-1 holders a problem getting married without SSN.

K-1 by itself is not work authorized with out EAD, either by a stamp, or card from USCIS. Some border crossings from Canada will stamp the K-1 with temp EAD stamp, and only a few airport POE still do the same, JFK is one.
