Having just arrived back with my mother from the UK, my mother who is 74 was told by the immigration that she can't continue to come over to the USA. She comes over in April stays around 85 days, and returns back to the UK until November then she comes again and stays a further 85 days and retuns back to the UK until April of the following year, she has done this for I would say 3 years now. The immigration officer told her she can't do this on the I-95 VWP any longer cos she is spending too much time here. She told them but I come to see my daughter and I am retired, what harm is there, after all I spend 6 months of the year in my own country of the UK and spend the rest of the time here, she was told to pop to the embassy on the way home from the UK and get another type of visa I presume the Tourist visa, anyone else had this experience?

Pop to the embassy? all that way? do they see thats she older and can't just pop anyplace???

I would say a tourist visa, yes. As with the regular passports, you are only allowed to stay 3 months at a time in the country, then you must return to your own country...not sure for how long though. They maybe just never said anything to her up until now because she is older....there's alway's one person that has to ruin it..lol. tongue.gif But, unfortunately, she would have to go to London to see the consulate there about the tourist visa. My suggestion would be to check out the London Embassy website also, to see what information she could possibly get off of there/ and/or fill out ahead of time.

She does't really want to go down the route of a 6 month visa as she doesn't stay 6 months, she only stays less than 3. If she got a 6 month visa don't know how long she would have to stay away until she could apply again for another 3 months

My guess is that he was referring to an Immigrant Visa, not a Visitors Visa. They think she is living more here than elsewhere.

Having said that she has a good chance of a B and that might do the trick. Both Visa's allow visits up to the max on both that woud mean being out of the country more than in it, POE obviously felt she was pushin it.

Where does she get her travel insurance btw? Cost a fortune for my Mum for 2 weeks.

She gets her travel insurance free with the bank, she pays for the additional month seperate.
