Hi Guys,

I called USCIS again today, after I received a letter from the California Service Center on the service request that they have filed for me, to check on my EAD application (filed 1 June!!). Of course, the letter didnt tell me anything that I didnt already know ie: 'The case is currently under review'.

What frustrated me so much was that the USCIS person I talked to said that I have to wait another 60 days from the date of the service request letter which is Oct 23!! My case is already almost 3 months over the normal processing time, and now they tell me to wait another 60 days!!!

How can that be possible? If that is the case, then I wouldnt have spent the $180 to file this application, which is a total waste of money since I am expecting to get my AOS by Dec too!

Is anyone else experiencing the same problem, and could we ever get a refund from USCIS if the green card comes before the EAD? It's sickening how they always tell me to be PATIENT AND WAIT!!!!

Appreciate any comments.

I am sure I will be in the same position. I am at day 118 on my EAD and I have a service request in, but there has been no signs of life on my case in a long time. There is no chance of getting a refund, they state that clearly. You send them money, it's now theirs.

I would call back and pester them, or if you can make an Infopass.

I think someone else just posted they received their EAD after 123 days. Hopefully you are close good.gif

Dont know why you all bother phoning the 1-800 number they can do nothing.... if you want to chase up your EAD then make an infopass appointment at your local office.... they can contact the person who is actually working on your EAD and find out what is holding it up.... they can also request a decision be made it or an interim EAD be issued....

Have you contacted your congressman? I'm actually in the same boat as you are. EAD application was received by USCIS on June 17. Made an infopass a couple of weeks ago and immigration officer said she'd fax CSC. One week after that infopass I still had no touches so I decided it was time to ask my congressman for assistance. On Oct. 31, I got a response from his office and said that the application was still under review and that I should give it abt. 30-45 days. But I think the congressional inquiry must have done something because I've been touched two days straight since Oct. 31. Well I am not all confident of an approval coming my way soon (it's hard to keep getting disappointed) but at least my EAD is now showing some signs of life.

I tried to make an Infopass but they wouldnt let me- I think there are no free time slots in the office near my area. I dont think I want to call them back again, because I get so furious and disappointed whenever I hear something ridiculous from them!

Ya, I know there's no such thing as a refund from them- but this whole thing is just driving me nuts!!

Yeah I guess I would have to contact my congressman soon and seek his help. Like you, I am so tired of being disappointed and tired of waiting and waiting and waiting... Thanks for the advice.

I guess I was basing my expectations of getting the AOS based on the timeline and normal processing time- and hope and pray hard that this time, they will adher to the specified processing time. But then again, we all know when dealing with USCIS that the probability of that happening is going to be very low.

There is no 'normal processing time' for AOS - timelines are also relatively moot.

All you get from normal processing times and VJ timelines are mathematical norms of completed cases. You don't get any information about cases that are NOT complete, therefore readers have no idea exactly how many people are still awaiting greencards.

AOS isn't like filing a visa petition. FBI namecheck alone can throw a ringer in your personal processing time. There is too much performance variance at the different district offices. Even a transfer of your adjustment to the CSC doesn't assure you swifter processing - about all it means for most is they will not be interviewed. Instead of having an interview, you get left in the dark with absolutely no information about your case. Personally, I'd rather be interviewed.

Hi cellarlily- yeah, I have been trying almost everyday now to make an infopass appointment, but they wouldnt let me. I have already contacted my congressman via email for assistance on this, I guess all I can do is wait and pray hard for a miracle to happen and my work permit gets approved before the end of the month!

i DO NOT get why you kept saying that you were not allowed to make INFOPASS appointment. just go to the USCIS website, click on 'infopass' logo that takes you to the appointment webpage and i assume EVERYONE can make appointment w. your district office. i don't see any reason why they would BLOCK specific few people online. that's not logical at all. don't expect to get much help from 1800 number. infopass appointments will help much more. just be patient, check out the USCIS website, and follow the appointment instructions step by step, then you'll get there. there's no guarantee that you can get the appointment for the next day depending on how busy your district office is, but you can choose the possible closest dates for you online. just remember to print out the appointment page, bring it with you along your photo ID and all copies of your applications when you go to the office. good luck.

i wouldn't recommend making appointment w. other district offices other than the one w. real jurisdiction over your residence. the thing is that i went to NY office last week cuz it's MUCH closer to me by distance in attempt to expedite AP. they almost gave it to me right after the conversations till they found out i currently live in CT. they apologized but turned down my case because of the jurisdiction issue. that means i have to spend MUCH longer time taking a train to Hartford, CT and start all over again. but what can you do? regulations are regulations. FYI.

I wasn't saying change your zipcode to reflect a whole other state, I am simply saying for some reason, using nearby alternate zipcodes can have an affect on appointments that are actually available at your own local office. Most places have more than one zipcode in the same area, I am suggesting to try them all. We have had others have success with this.

for example, in case I am still not being clear -

Let's say you live in West Hartford, and there is only one local office in all of CT. You can try putting in an East Hartford zipcode to still get an appt at the same local office, but at times, different options are available. I don't know why, nor do I necessarily care, but if you mess with it within it's own guidelines, you may have some result.

I finally managed to make an Infopass appointment! Before, they usually say "Infopass is unable to process your appointment..".

Hopefully this will help to speed things up...
