HI,

What is the quickest way for my daughter to come live in California with her mother and step dad? She is 26 yrs old. Work visa, relative visa or whatever other one works? She has worked in child care for many years. Could she come via a work visa and then apply for permnament residence as this will get here but still have to do the process. I hope someone can help me. I am a permnament residence married to a US citizen.

Petitioning for children to immigrate to the US, will take quite a long time, especially if they are over 21. The only type of work visa that she could adjust status from are those that are considered Dual Intent, like H1B.

For Family Visas, she would be in the preference category 2B, which has pretty close to a 10 year wait. You could file now, and upgrade your petition to first preference once you become a citizen and save a few years. However, if she gets married in the meantime, she will go into the 3rd preference category (unless she marries someone from the US, and then she could use a marriage visa) and you will have to be a citizen to file for her in that category.

Find her a USC fiancee would be quickest.

LOL. I have thought of that too. So I am keeping my eyes open. Thanks for the comments. Could be 3 years depending on the centers time line. There should not be a long time line for immediate family. Children should be priority no matter the age. Actually all 3 of my kids live in Canada and would love to live near me. All 3 are over 21. The youngest did come here with a visa but was so home sick we never filed for perm residence. He now wants to come back but just turned 21. I really wish they did not make it hard for the children of a legal immigrant. Other family members I understand but not your children who want to be near their parent.

The prospect of moving in my parents would not be that attractive. I know of nobody who would want to!

My stepson, wife and daughter moved in for 6 months, turned out to be a nightmare. I was happy to pay for the moving van.

It will take a lot longer than 3 years for an over 21 child to have a visa available to them... I have an approved I-130 for my over 21 years old son.... the wait after i-130 approval is about 8 - 10 years for a PR and once I become a citizen it will drop to about 6 years.... so not sure where you are getting 3 years from....

Over 21 unmarried child of PR is in category 2B...... so people who have an approved I-130 dated Sept 15th 1998 are now being issued with the visa application package....
