Is there anything wrong with my fiance doing volunteer work while she is waiting for her AOS? Like volunteering at boys and girls clubs.

It depends. I am on an H1-B and as such I am allowed to work for my sponsoring employer and noone else. So basically my situation is the same as someone doing AOS except I have only one possible employer I can work for In my status I am not allowed to volunteer in any position if that volunteer work would take away from that work of any normal paid position. So I volunteered for Big Brothers for a while, but then when I thought about volunteering with the Seattle Symphony, I realized that might be iffy. So you may want ot be careful about the position she takes up volunteering while waiting.

Yep, I would be careful. You may think you're doing a good thing but you never know. Basically sit in a dark corner for 6 months and don't make a peep. LOL

Actually I think you can do volunteer work, providing you do not collect any pay, besides, she can also ask the club if they would consider in writing an affidavit about her volunteer work, to take with her to your interview.

I did volunteer work for an animal charity whilst waiting for AOS, and I checked with USCIS to make sure this was allowed. Their stance was that as long as I didn't receive payment, it was fine.

You're welcome !! Also it looks good with future employers when your SO does apply for paid employment. It shows she has made an effort whilst waiting for AOS, and has used her time productively and for the benefit of the community. smile.gif

Volunteer work is generally fine as long as the position is not a position that would usually provide renumeration of any kind.

We checked into this as well and got the same answer as above.

Plus, she may be able to use them as a reference if she wants to work.

Yes it is perfectly fine,I did it while I was in the US on my Visa Waiver Programm,they did a few checks and asked me for my SSN# which I did not have obviously.
But I worked in a hospital doing office work,without a pay of course. Got free meals though so it was okay LOL

I have a question concerning the volunteering for work without pay. My husband arrived in the states on a K3 and he just applied for his EAD in Oct. He wants to work so bad and my dad and his boss would like him to come work with them 1 or 2 days a week but they don't want my husband to get into trouble and they don't want to neither. Is my husband allowed just work with no pay while waiting his EAD or should he wait just to be safe?

Technically, no

if it would normally be a volunteer job, yes. but if it is a position that could turn into a paid position, no.
