Hi guys i came here with K1 visa sept5,2007 and married oct 4 of this year. We go to SSN office here in albuquerque NM yesterday to apply social security number for me but the clerk said that they cant give me SSN until my status is not adjusted or i have my GC, EAD she said comeback again if you have that already. We are preparing for the adjustment of status papers. Any of you have experienced this? I dont understand why they refused me as far as i know and i read some post here they got thier ssn number even though their status notyet adjusted.

My question is should i wait my status to be adjusted then file SSN? helpsmilie.gif

Thanks

you should be able to at least receive a soc sec card with "this card is not authorization without DHS work permit" or something like that printed across the top.

my new wife applied for hers one week after we were married.

she took a copy of our marriage license, her passport with the K-1 visa and stamp of entry, and then they gave her a soc sec card with her new married name.

perhaps you should go back and politely ask to speak with a supervisor.

you swhould not have to wait for the green card and AOS to receive a soc sec card.

that is my 2 cents.

You can apply for a social security number on a K-1 visa, provided you have a certain amount of time left on your I-94, which you do. Based on what you said, I believe the employee you spoke to did not know what she was talking about.

You should print the above, go back and show them their own regulations... or speak to a supervisor, like someone else suggested.

This is accurate. Print out this information and go back! When I first applied for my SSN on a K-1 2 weeks after my arrival in the US I was told I couldn't have one until after I got an EAD or AOS. I took back the printed out information, gave it to them, they went back and obviously reviewed it with a number of other individuals in the back office, then came out and accepted my application. I received by SSN card about a week later. If, with the printed out information, the person doesn't wish to accept your application, ask to speak to her supervisor or a person higher up on authority until you get someone who does understand the relevant legislation.

Good luck.

You have a couple options. One go back to the office and start screaming for the office manager and tell them to read
RM 00203.500 C1 and RM 00203.210 C or two go to another office and don't say anything about being married and apply in your maiden name.

Try another office or ask to speak to the supervisor and present the instructions from the link above.

Thank you guys

I went to get my SSN on Monday (in Monroe, Louisiana) and was refused too. I explained to the lady about K1's being allowed SSN's but she said that the computer would not let her go any further. I think I will go to another office armed with the RM 00203.500.

You should be able to get an SSN prior to the expiration of the I-94. Maybe you should try a different office.

We went to SSA today armed with I-94 and marriage certificate.. The woman told me that i need to change my status first before they could give me a SSN because in their computer database my married name and my immigration info mismatch. She told us to have it adjusted first..

That is total BS if you haven't been here over 76 days.

At which SSA office did they tell you this?

RM 00203.210 C. Procedure - Immigration Document as Evidence of Legal Name:

When issuing immigration documents, the Department of State and Department of Homeland Security issue them in the person’s legal name. The legal name is also generally the name in which the foreign passport was issued.

When an alien applies for an SSN card, we presume the name on the immigration document is the legal name unless the applicant presents evidence of a legal name change, e.g., marriage, which occurred after the immigration document was issued.

It seems lots of SSA employees don't even know the rules and regs of the agency.

We went yesterday to SSN sandy utah. The lady was nice she asked for my passport,1-94 and marriage contract. She said that they will verify first the record to the USCIS and it may take 4 weeks and if i am on the records then they will mail the Social security number. I am not going to wait that because my I-94 will be expire the time that they give me number. So i might file the adjustment of status without SSN.

yes.gif the clowns here in kc didn't want to give nessa a ssn because she didn't have the ead stamp on the i-94 - so a quick trip down the road to uscis solved that - they stamped her i-94 and then back to ssn. nessa got the ssn about 2 weeks later.

Im not going to wait the SSN we will file the adjustment of status now and see what happens because my I-94 will be expire december 04 so if i wait the SSN its already expired because social security clerk said that it will took 4 weeks to verify the records from USCIS if i have a record with them then they will mail the ssn to me.
