any idea how uscis would view a deferred prosecution for class 4 misdeameanor dv?

arrest was for spanking child.. took 4 parenting classes and thats it...

deferred for two years, one more year to go..

I answered no on the application because I was told by my attorney and the
court office that it is not a conviction..

It is set to be dismissed in a year, or I could possibly file a motion to have it
dismissed now.

no other offenses....

wondering if I will get an RFE for this.. My fiance knows about it.

The particular area of the country I live in has gone to the far extreme in dv arrests..

The form asks about convictions. No prosecution or verdict means no conviction. At worst the fact is you don't have one yet. I say the answer is no. When you answer "no" to my knowledge that's the end of it. USCIS sees the "no", not the deferred prosecution.

we were approved and they didnt ask for anything about it..

waiting for paperwork to go to embassy now.
