Full Version: What Consulate to Put Down?

Hi -

My wife is a Canadian citizen and lives in Mississauga. The Toronto consulate is the closest to her and services the Mississauga area. I was talking to someone on this forum and that person told me that my wife cannot apply for the visa at the US Consulate in Toronto, but rather she will have to apply to the US Embassy in Ottawa.

I ask because I need to write down on the petitions for I-129F, where she will apply for the visa and I have stated on the form Toronto, Canada.

What is the correct answer to where she will apply for the visa. I personally thought that she would apply at the US Consulate in Toronto.

What are you applying for? K-3? I believe she would be going out of Montreal in that case..

Either way, I think we put down Halifax on our petition, but they figured it out and assigned us to Montreal.

Yes, I am filing the I-130 and the I-129F for my wife. So are all K3 visas applied for out of Montreal? I thought the local consulate could issue the visa?

Ok so you are applying for the K-3.

You didn't answer whether or not you are living in Canada too - it's important as you can't file at the consulate if you don't live in Canada too. To file with the consulate/embassy you both have to go there in person and you need to be a resident of Canada.

If this is not the case you will need to file with Vermont.

That said - since your wife lives in the Eastern part of Canada she will interview in Montreal. Interviews for K type visas only take place in 2 places in Canada - the Montreal consulate and Vancouver consulate, as she is closer to Montreal - she will interview there.

So I think where the confusion is - is between interview and applying.

Applying - if you are also a resident of Canada you may file your I-130/I-129f at the consulate or embassy.

Interview - Montreal (as you are residing in the Eastern part of Canada).

Based on the instructions, the application for the visa should go to the consulate in the country that the non-USC spouse resides in.

Well I'm not all that familiar with the K3, since we didn't apply for one, however someone who has done one will hopefully come along and join in this discussion.

No I wouldn't put Vermont there, it says you must put the appropriate consulate of the country where you were married (Montreal - if you married in Canada) or the aliens country (Canada), if you were married in the U.S..

The LIFE Act requires applicants to apply for a K-3 visa in the country where their marriage to the U.S. citizen petitioner occurred. Petitioners should make sure to identify the appropriate consulate, in the same country where they married the alien for whom they are petitioning, in Block 20 to avoid lengthy delays. In the event the petitioner and alien were married in the United States, they should list the country of the alien's current residence.

Now as to where you actually mail your petition - that depends which State you live it, it will either be California or Vermont.

Put either Montreal or Toronto, it doesn't matter. It will go where it needs to go, which is Montreal. My fiancee is in Sarnia, and Toronto definitely would have been easier to go to for the visa processing, too. I put Toronto, and we're at the last step, just waiting for the 9th of November to get here.

Great question, can anyone tell me. If I apply for CR-1 it will go through Montreal for interview and paperwork. If it is the K1 or K3 it can be processed in Vancouver. I am Canadian on Vancouver Island and the other half is US American in Utah. His filling office would be Salt Lake City.

Put either Montreal or Toronto, it doesn't matter. It will go where it needs to go, which is Montreal. So it's decided I will be putting down Toronto as the correct consulate where the visa will be appied for.

BTW, my wife and got married in Toronto. It was marvelous wedding!!

If you apply for the CR1 your interview will be held in Montreal.

K1 and K3 can interview in Montreal or Vancouver, depending on where they live. smile.gif

Cr-1 (ir-1) All interviews for Canada goto Montreal

Since your on Vancouver Island, your K3 would be in Vancouver!! Which is good, since when it comes to getting an interview appt. for the K3, Van is much faster then Mtl, if you go the K3 route

Thank you all. After reading the timelines. I am really really looking at the K1 route. It has been a long time to me already and I really don't want to be spending another year here. Running two house holds is expensive. Since I have a 10 year old there will one for him too. I believe I've seen it on here K2............
