Full Version: Concerning I-765 form

Hi I'm new to this section here and hope that you can help me.My husband just arrived this month on a K3 Visa and he wants to get his EAD papers out this month also. I have told him that it could take 3 to 6 months for the process to be complete. I have just a couple of questions before sending them out though.

1.) Question #15 on the I-765 form

Current Immigration Status (visitor, student, ect)?

My husband entered on a K3 visa, I just put that right?


2.) Can I file just for the EAD for now and apply for the AP/AOS in January? We don't plan on leaving the states maybe a trip to florida next year but thats all. Plus, our 2 year wedding anniversary is in March. According to what I have read on VJ, and heard,that he would be able to get the 10 year GC instead of the 2 year, is that correct?

3.) The only things we have to mail with this form is the M/O for $340, a copy of the I-94 he received at airport, 2-passport picts, and copy of his passport (does it have to be all pages like before with the I-129?)

4.) This is the part where I'm confused on, for question 16 on the I-765 form we put (a)(9) but it has like 3 different places to mail our form to (we are from Wisconsin).
One is to Lincoln,NE-----One to, Laguna Niguel, CA------Last but not least, Chicago, IL. helpsmilie.gif

Please if you can help us that would be so great. We plan on mailing the pkt out today.

1) YES

2) Yes, though you will be paying a fee for EAD $340, this type of EAD will last about 2 years for K-3 and allows work and to get SSN and perhaps a driver's license. Many K-3's do this so that they can file the AOS package close to 2nd wedding anniversary, to avoid getting a conditional green-card.

Also K-3 does not need AP, the K-3 is a multi entry visa.

3) Just a copy of the visa and biographic page from the passport. Two passport photos, MO, and copy of I-94. Use a personal check instead of the MO, you can then track the petition by seeing the check get cashed, and perhaps get case number of the back of the check.

4) I-765 should be code (a )(9 ) for K-3, and mail it to the service center that has jurisdiction over your place of residence:

Thank you much smile.gif That's where we sent the papers. I didn't get to send a personal check because I ran out of checks and was waiting for them to arrive but they didn't yet so we just mailed a M/O.
