Hey guys,

Hoping to get some help here.
Had the K1 - came in, got married and picked up and EAD in JFK on the way. Got my social.
Applied for change of status and currently waiting for Greencard interview. Had my biometrics at the weekend.

Question is - can I still work while I wait on the greencard and extended EAD?

Do the government expect you to work for 3 months prior to marriage and remain unemployed until your Greencard comes or what are people's experience?

Thanks in advance
Karin und Otto
No, you are not allowed to work right now , you have to wait for your EAD card or greencard. According to your timeline you enterd the US in June, the EAD stamp from JFK is only valid for 90 days. The same happen to me - I am waiting for my EAD card too, although I never used my "90 day work permission".

Best wishes

Yep, once you married, you voided out that temporary EAD. You have to wait for AOS. It sucks, I know. Took Andre nearly 7 full months to get to where he could look for work and then get a job.

Be strong and patient. In the whole scheme of things, it's just another short wait.

The temporary EAD terminates with the I-94, not with marriage.

so where does that leave me?

I am working at the minute - and just had my biometrics - my new EAD arrives in less than 4 weeks.

Should I quit my job - will they / I get in trouble?

Very worried here!!!!! wacko.gif blink.gif

How do you know you will get your EAD in 4 weeks????

Your work authorization ended the same day as your I-94 expired.... so no you are not authorised to work... because you are married to a USC any unauthorized work will be forgiven at AOS interview..... BUT your employer is breaking the law... and yes they could get into trouble... they should have reverified your work authorization around the time of the expiry of your temp EAD so that they could comply with the requirements of the I-9...
