You are in AP/AR and there is no predictable time when it is completed.
It can involve background checks and security checks, name checks, etc. If one senator's aide was not helpful try the other one and your congressman. They can not speed it up but may get more detailed info on what type of check it is then again they may not.
After a congressional inquiry they have to respond, even if it just to say it is still being investigated. Lets them know you are still there ....waiting.
So sorry and hope it will be completed soon.

I'm in the same boat. Filed I-130 in July 2006, recvd NOA1 2006 ... nothing to date except comments that I'm in background checks.

I have contacted Senators and Congressman and lately the CIS Ombudsman. The USCIS still simply tells me that I'm in background checks and I will have to wait. Personally, this only makes me very dis-satifisfied with the USCIS.

I will consult a lawyer soon. I will at least talk to them, I don't think I can afford to retain an attorney. But the Writ of Mandamus might be my only course of action. I don't think this is fair to be treated this way by your own government. I'm an American citizen, that is supposed to mean something.

Does anyone hear have any information on this matter as far as filing the papers Pro Se (as an individual without a lawyer)?

My suggestion is to consult a immigration lawyer.

For extraordinary delays there is something called a Writ of Mandamus. It is basically a law suit. But hopefully, it would compel the USCIS to expidite your application before they would have to go to trial.

I just spoke with an attorney, not much help... he didn't think 15 months waiting for a NOA2 was that unusual. I didn't get the feeling that he was very knowlegable about the Immigrations process. My job paid for 30 minutes free consultation, I talked to the guy for 11 minutes. I probably need to talk to another attorney. I asked him about the writ of Mandamus, but he wasn't very knowlegable of it.

There is not much support in this situation.

Writ of Mandandus can take 18 months or longer.

Closing the case out and refiling can present you with the same background checks all over again, which will prolong the time.

I would only contact a lawyer who specializes in these type of cases, not just any immigration lawyer.

How many cases has this lawyer successfully completed to tell you this is the way to go ? Or is he just guessing ......

Do a search on Marc Ellis, a lawyer who may be able to help you, at least advice you. He is often mentioned here on VJ.
