Hello all, am I glad to have found you guys.
Here is our situation, I'm a USC and my fiance (we'll be married this fall in Florida) is a Filipina and we both work on a cruise ship. As a result, she has a transit visa that allows her to enter the country one day at a time. Our contracts end on the same day in April so if we hurried within those 24 hours and were to apply for the CR-1/IR-1 and submit the I-485, would she then be legally allowed to stay in the states while the application is processed? If not, we think she can adjust her transit visa to a tourist visa, could she come into the states for say 30 days and then apply as mentioned and stay legally? Is this the function of the I-485?
Less pertinent, once she has the CR-1/IR-1, do you think we could continue working on cruise ships? Lastly, what does "AOS" stand for?

I didnt know much about ur case but AOS stands for Affidavit of support (I-864 I guess) or Adjustment of Status for the Kvisas. USEM dont issue a tourist visa as easy as that. But I am not sure maybe somebody can answer and help u. Goodluck.

My initital reaction is that it would be visa fraud as she would have the intention to immigrate upon entry, but from the post above mine it seems to be something to look into. Do be very careful though.

You can't apply for change of status or adjustment of status while on D visa. (Transit visa for ships crew).
