Full Version: Refused to issue Social Security card

One thing about the process we go through ... there are always surprises.

Today we took our K2's shiny new GC and all the supporting documents needed to our local Social Security office with the expectation of filing for a card. We were told that the SS card will be automatically issued by virtue of USCIS action when they issued the GC. We could not file today. If we don't have a SS card in the next 30 days come back and file.

I started to explain that this was a K2 visa and an AOS not an immigrant visa where a GC is issued upon entry ... the clerk's eyes immediately glazed over and I knew she wasn't listening ... "Come back in 30 days sir, come back in 30 days".

I know that K3's and I presume maybe K4's sometimes get the SS card automatically but has anyone heard of this happening for a K2 ... or a K1?

You were given absolutely false information.

Once a K-2 receives the GC, they immediately become eligible for a SSN card. My daughter applied for her SSN 4 days after receiving her GC and the card arrived 6 days after she applied.

Go back and demand to speak to a supervisor.

Unfortunately it was the supervisor. I told her that her office issued the SS card for my K1 wife just as I was trying to get them to do for the K2.

I guess we'll try at another office.

Is your daughter's experience recent?

My daughter got her GC on March 6, 2006, went to the SSA office on March 10, 2006, and received the SSN card on March 16, 2006.

And, as far as I know, the rules have not changed with regards to SSN's for K-2's.

I would definitely try another office. I'm sure you won't have any problems.

You are thinking of the IMMIGRANT CR-1 or IR-1, they can check a box on DS-230 part 2 that requests a SSN be issued, as well as the green-card.

We may have a solution and, in fact, a new technique ...

I called the national Social Security customer service number and, after waiting only 38 minutes (thank God for speaker phones), spoke to an agent and explained the situation. She consulted with her supervisor. They put me on hold and did research. They came back and said I was exactly right. They called the Brea, CA SS office that had refused us and spoke to "a manager".

Bottom line is that Social Security has apologized to me for the inconvenience and assured me that, if we come back tomorrow, supervisory personnel will personally handle our case.

It almost felt good .... we shall see ...

I would love to see the face on the SSA moron when Jim goes back to deal with them.

I know of Jim's dealings well, he managed to get an emergency AP out of USCIS awhile ago without an emergency, it all goes to how you handle government officials, that time being nice worked, this time it took a phone call.

This afternoon we made another run at Social Security. I noted that as soon as we came into the SS office the lady we saw previously finished her customer and closed her window. We were the next people called despite approximately 20 people ahead of us. We made no mention of the incident yesterday and neither did the person handling our papers. She was very polite and zipped through the process until suddenly a big frown appeared on her face as she read something on the computer screen.

It turns out that even though USCIS had accepted our K-2’s name change and issued the GC in that name they had not changed the SAVE data base and there our K-2 still had her old name. The lady apologized and said that SS could not issue a number with a mismatched name and further that USCIS had to correct the SAVE data as she could not change it. She also cautioned that when it is changed we should wait several days for the database to be updated.

During our AOS interview the Immigration Officer did mention that she was changing the name in “the database” and made several entries. Apparently the database she changed at AOS is not linked to SAVE. I believe SAVE is also what California DMV will check in the driver’s license process … so it is quite important to get this right.

I called USCIS Customer Service to verify how to change the data in SAVE. As I suspected, they said it required an InfoPass appointment. We have made an InfoPass appointment for this Friday. I’ll post an update with the results.

Sigh …

We're getting closer ... this afternoon we had an InfoPass appointment in Santa Ana. The Immigration Officer was very nice. Once we got him past the idea that my daughter was my wife he filled out a form, took copies of a few items from the AOS filing, spent a good five minutes speaking with his supervisor, and then said the name should be corrected in SAVE within two days.

Tentatively we are planning another run on Social Security on Wednesday.

Once again you were given a line of BS by this office. If the initial verification doesn't verify they are to send a secondary electronic verification request. I would go back to the SSA office and be sure that was submitted.

BTW at which SSA office do these geniuses work?

What numbnut was thinking about was the Enumeration At Entry process and even if the kid did just come in the country with an immigrant visa, the process only works for people age 18 or older.

I can totally sympathise with your run in with the SSA. I just today received my ssn in the mail after an 8 and a half week ongoing battle involving 5 visits to two different SSA offices and an infopass appointment, 3 calls to the USCIS hotline and 2 to the SSA who told me totally different information to the clerks at the 2 SSA offices who also contradicted each other. Plus a supervisor who wouldn't talk to me as she 'doesn't get involved with case work'.

True genius at work. The funniest thing was the quote on the back of the envelope the card camein: 'For the times that count, count on Social Security!' - yeah, I'll remember that in future...

Hey jim_julian I think you have no luck. I had deal with SSA before. Since I moved here with K1, and I got SSN after I got married before I get Greencard. I think it depend on the office and the officer on that office too.

Talking about changing name of your K2, you have no luck too. I got a greencard and I went to change my SSN, first the officer was a little confuse about my name too, the other officer come to help him. I got SSN in 1 week or so after that. I think the officer which you deal with didn't know how to work (I belived that.)

Anyway I hope you get SSN for your K2 very soon

Got it! (errr ... as long as it comes in the mail)

This afternoon we visitied the Brea, CA SS office again. As luck would have it we were seen by the lady who originally turned us down.

I greeted her and suggested she check the SAVE database to confirm that USCIS had cleared the name mismatch. She didn't say a word ....

Type, type, type ... click, click click ... she pushed a printout towards us for review and signature. My daughter and I looked it over and I said that there was a mistake in her mother's name ... shoudl be a "q" not a "g". The SS lady said "Well it looked like a "g" to me!"

She corrected the form. My daughter signed it. I thanked her for her assistance ... she said nothing ... we took our receipt and left.
