Hi everyone, I wondering what a friend told me, she said that if my fiance comes to the usa by Dec and we get married
I have to claim him on my tax papers. But someone told me I do not cause he was not living with me for 6 months. So, I dont know what to think anymore. Can someone please help me with this. Thank You

that is a good question...if he comes in December and you don't get married in Dec...then you could file single...and I believe that even if you get married in Dec...you could still file single or head of household....shouldn't be too much of a difference. But I could be wrong

Unless the tax laws have changed--- my last marriage I was married in December and our Accountant filed us as Married for the entire year. I believe the 6 months applies to dependants.

You have to identify as married but you can file as married filing separately but since he has no income, I would think that having him on your taxes would be a benefit to you. Plus, it would be proof for your AOS. Whatever your status is as of December 31 the previous year is what you file as on your taxes.
