Full Version: DCF questions, is it right for me? (Colombia)

i am planning on marrying my future wife soon so we can go to the states. we live in Cali Colombia, i have dual citizenship US and Colombian citizenship. she is a colombian citizen, we want to go to the US to live and dont know whats the best route for us DCF or K-3 visa?....she also has a daughter so we want for the 3 of us to all go together....is DCF the best route for us or is the K-3 best for us? where do i start? i have many questions and need guidence in what and where should i start. any recommendations in what i should do? DCF or K3, how long does the DCF take? is it recommended for me to get a lawyer? or best for us to do all the runs ourselves? is it a real complicated process? well i'll start with those questions and wait for a response, thanks in advance and i'll post back in reply soon...thanks

If you are resident in the foreign country, do DCF, it results in an superior immigrant (IR-1 or CR-1) visa that gets the immigrant a green-card upon entry.

K-3 cannot be filed (DCF), K-3 can only be filed through USCIS in the USA, has the pain of having to file for EAD and/or AOS in the USA in rder to get the green-card, EAD can take up to 90 days to get, AOS can take a long tome to process, and AOS costs $1010.

Consider the K-3 very carefuly.

DCF is considered to be the fastest for processing.

One thing that hangs some on DCF is Domicile, and IRS returns. Both are needed for the I-864 required from the US citizen filing the DCF petitiom.

Dan pretty much covered it but as I see it, unless you have domicile in the US now, your only option is to file DCF. Then you get to deal with the US domicile and tax returns before the interview. Do you have domicile in the US, or parents or family addresses you could use with their invitation? You may not owe any US taxes but you'll need to file at least one tax return to include with your affidavit of support. Unless your current income will continue from the same source, once you're in the US, you'll likely need a joint sponsor or to return, establish domicile and get a job.

There are lots of considerations but probably all can be dealt with.
