I felt I needed to bring this old thread to this forum, becuse it is buried in the AOS/green card forum. I hope someone has some knowledge on this matter .

Have you tried your senator? Most seem to have things set up for this type if inquiry and investigation. I looked into it when Manila misplaced Claudeth's police clearance translation.

Firstly what is your status in the USA, Citizen or LPR? Both citizens and LPRs can file I-130 but it can take a few years for a the I-130 to process through USCIS to NVC.

If you are a US Citizen, I would be contacting a lawyer and asking filing a Writ of Mandamus lawsuit would pressure USCIS to get moving on this. Sometimes the threat of a lawsuit causes them to move on this.

Lastly, you may want to check out "A Candle for Love" that site specializes in Chinese immigrations issues. http://candleforlove.com

I'm a US citizen, I did send a email to the AILF. I'm awaiting thier response. I can't afford a lawyer, so i would need to do the Pro Se. To think other come here illegally and I'm trying to do it legally and my goverment is not supportive

I'm aware of CFL, but there is no real help on this situation with the I-130, only AOS... I was hoping someone here had some experiences... I guess maybe not

I just wanted to update this thread.

I filed for a K3 in Feburary because I felt very desparate to get my wife here... but In my heart I felt I was being forced to do so by the lack of action by the USCIS.... I felt I wouldn't get the benefits that were due to me with a CR1 as oppossed to a K3.

Any way, to make a long story short.... I filed the Writ of Mandamus, Pro Se(myself) and 2 weeks later I received an approval of my CR1 petition, which will now be a IR1 petition(10 year Green card).

I would say while the Agency wasn't doing what they should have been doing and denying me my rights, being in the great U.S.A. allowed me to fight for my rights in court and receive satisfaction in my situation.
