Hello,

We are eligible to file our I-130 in Sydne, Due to my husband being resident for more than 6 months. They have scheduled a day for us to lodge that form in Sydney on November 15th 2007, but i have already completed my medical and police report, and i have all of the required documentation in order, so has anyone heard that they are still processing DCF the way they used to before the Adam Walsh in these cases? Can we try and file our actual application the same day they are requesting the i-130, like you used to be able to do? helpsmilie.gif

Technically, without an approved I-130 you are not eligible to apply... since they I-130 needs to go to a USCIS foreign field office somewhere (BKK?) they cannot do same day adjudication (maybe like they could before) .... Will the consulate accept your application pending approval is a question only they can answer specifically

YES, They began accepting I-130 filings at the consulate a month or so after they stopped last Feb.

Keep in mind police cert and medical needs to be less than 1 year old when you interview

I think the OP understands that the I-130 can be submitted but the question is will they also accept the DS-230 and other evidence on that same day as well...
