Who else is waiting since 2006 or even before that? I always feel forgotton on this forum because people are worried about having to wait for 6 months or 3 months. I am sure that there are more people waiting like I have been. And please dont give me the advice that I should contact people to help. Trust me I have contacted everyone that I can. The problem with Senators and Congressman is they can only do an inquiry on your file. I can do my own inquiry. Also anyone from MENA- has anyone successfully claimed descriminination and won that anyone is aware of?
CairoBound
Yeah - we've been waiting since 2006. We've been on Administrative Processing since November 21st - that's over 10 months of waiting. I finally got fed up and wrote the governor. Received a letter last week that they are checking on our case and will let us know. I'm crossingh my fingers - do we have to wait a full year to make a difference?????

Ruthanne
We are waiting for name checks to come back so say the goveners. Cant call for 6 months from the last inquiry. We shouldnt have to wait all this time. Its not fair when others can get by with a 3 month wait. Nobody can do anything to help though. They just can make an inquiry on your behalf. We have been thinking about forgetting the visa fiancee and just getting married. He is worried this will never go through. Cant say I blame him. This isnt easy no0pb.gif

I'm sorry to hear about your wait. This process does seem incredibly unfair at times and I do understand your comments about people being impatient when they're only 3 months into the process. I'm afraid we all want the same thing and it's easy to forget sometimes that there are people worse off than you.
I hope you don't have to wait too much longer.
Ruthanne
Thank you! It is very hard to realize your coming up on 2 years of waiting with nothing else to do but wait. Puts a real strain on a relationship. Talk about a test of your love jeesh!

Yes, the process really tests relationships. I can't imagine anyone doubting the validity of yours though. It's ridiculous making people wait that length of time.

Oh lord....this post scares me. We are in background checks right now at the CSC...we are only at 10 months though, I can well imagine the wait is unbearable the longer it goes because I am about to lose my mind now. Ive contacted senators, congressman, the vice president.And nothing...just you are in background checks...I hope you hear something soon!!!

We are also having a hard time with the waiting. Not sure where to turn to next, or maybe just try to say forget it. But, how can you say forget it when you truely love someone. Should I visit? Should we get married? How long will I have to wait if we get married vs waiting for the visa fiancee? nobody knows the answers to these questions. I hope you hear something soon also.

I really feel for everyone past the year mark and have to say I hope I never know what it feels like to be without a response for that long.

Just the 7 months since I applied is driving me crazy... although been seperated from my habbibi since May 2006 so I kinda do know how you feel. 4 days with him in the past 1 + years is just not enough.

I hope you hear some good news soon.... any news at all would be good i'm sure!!!!

Hang in there, it will eventually end at some point yes.gif

If you get married with a K1 in progress you have to start all over with a K3. If the K1 case is not closed properly you will have problems
with misrepresentation with a K3. You can't switch visa types in midstream.
You will run into the same delay with a K3 all over again anyway and K3 takes a little longer.
The best thing is to wait it out.

I know how hard that is, 9 months and counting with us.
sarah and hicham
Wow. That is just terrible. Good luck to everyone.

It's been over year (I130 filed in June 2006); and this is the latest reply USCIS sent to my senator:

This case file is currently pending detail review at headquarters. This process will take longer than normal for processing. Should USCIS discover information requiring further review and verification, the petitioner or applicant will be contacted. We appreciate your assistance and cooperation in helping us ensure the integrity of our immigration system.
Thank you

There is no answer to the long waiting time. Unless the USCIS asks us for something, there is nothing for us to provide. Patience is a virture.....and right now I don't have any!
~~~water~~~
I really feel for you omg... 2 yrs I can't imagine your right what a test to the relationship not to mention your sanity.....We have just been AP for 5 months and I can't breathe if I even start thinking about it..... I hope you visa is just around the corner
yes, we filed our first petition in this process in July 2002. It has been a long, winding, ugly torturous, unfair, degrading, et al road since then. We filed all the papers, paid fee upon fee, provided all the proof, our petitions were approved twice, but then were accused of fraud marriage, accused of lying, and accused of being inadmissible. None of the accusations with any evidence to support them and overwhelming evidence refuting them. But it wasn't until we got to the AAO that someone actually looked at our case without prejudice and finally acknowledged that our marriage is and always was valid, we never lied about anything and we were never inadmissible. We are waiting now on our 10th security check. You'd think after making us wait for all these years, 9 security checks would be enough.
The_dip_sticks
Omg I think this group is where we fit in too sadly but true. WE have been wating also for over a year. NO NOA2 in sight. Also getting married wont change any thing with seciruty checks, you might get stuck again and will be waiting double time. Blue blue what is AAO? You have been in USCIS for 9 years? OMG this nightmare cant go on. There must be something we could do. This is so unfair. Ins't the whole purpose of the K3 to reunite families faster allowing them to wait out the long I130 process together here in the states. My lawyer is saying that she will look into a WOM but Im not sure what that will do for us at USCIS. Im really confused and frustarted. Couldnt a group of us that have been wating stuck endlesly at USCIS get together and file a case action WOM? Blueblue have you been living apart from y our husband for 9 years?
blueblue
It's been 9 security checks since 2002, 5 and a half years separated because of immigration. AAO is the Administrative Appeals Office, part of USCIS.
The WOM can help to force the government to do their job. Depending on where your case is and how long you have been waiting on this action, it can help and is good your attorney is looking into it as a potential options for you.
How did you get to AAO, do you have to get reffered to them through some one or can any one stuck in USCIS for over a yr contact them?
So did you move to where your husband is right now to wait with him?. Im going on a year and a half at USCIS and I feel like my life is over. At times i feel lime im going mentally crazy, i feel like im in self destruct mode, we keep hitting walls and we have tried to contact every one we can but they all say there is nothing any can do to help when it come to these checks. My heart is bleeding here, when i saw that you been there for 9 years I felt like there is no hope for any of us that have been there for over a year at USCIS. crying.gif
This is like the worst nightmare. I dont get it how some people have it so easy but for people that are stuck at USCIS it's beyond hell.
I know how you feel, it does make you crazy, literally, and the only advice I can give is to just try to take it a day at a time and try not to think about it as much as you can. It only makes you crazier when you do.
The AAO isn't someone to complain to, we ended up there because at one point they told us we needed to file a waiver, then our waiver was denied because they said we were not suffering enough. The AAO then got the case and sat on it for 18 months until they finally said, oh yeah, you're right, you DON'T need to file a waiver.
I have been through the emotional ringer and my husband even more. Our daughter too. Unfortunately, we were not able to move overseas. At first we never expected anything like this could happen, then we thought it was just a mistake that would quickly get resolved. In the meantime, our daughter entered high school and I needed to care for my disabled brother, so moving was out of the question.
I hope that we will get the visa soon. I am waiting to hear what their next monkeywrench they are going to throw at us. It's been 2 and a half months since the AAO decision and we are waiting to know when we will have the next interview. It has definately harmed our family relationships. I am hoping we can overcome it if we ever are able to be together.
The one thing that has helped me is getting involved with American Families United. I want so much to help change the laws and processes so that other families do not have to suffer like this. You're right, when it goes right, people think it is so simple but when it goes wrong, they think you did something wrong, not the system and they don't have a clue of how wrong it can go and the devastation that it causes.
Keep your hope alive, it is a powerful tool and is the best thing to help you get through this dark times. Also, as much as you can, try to visit each other, that does help too.
I do have a CIS complaint address that may be useful to you. I will look it up when I get home and post it.
Its nice to hear from you again. I think of you often, and hope your case is resolved soon.
Sadly some people breeze through and some are put through the wringer. I can relate since my husband didn't get to come until after our 2 year anniversary. They do some major damage to our souls going through this. Getting married just starts the same process over again, so as much as it sucks it is best to stick it out. My husband kept telling me to forget the visa and move there, but it just wasn't feasible. I am glad that we waited though, he is here now and I will never let them take him away from me again.
The_dip_sticks
visa in hand was your two year wait at USCIS waiting for the noa2 or after the interview did youget stuck in Ap/AR then?
My prayers go out for all of you waiting. I hope you hear something in the very near future.
Well, I filed in December 2006 and at this point waiting for my case to be complete at the NVC and forwarded to Embassy.
What I would like to know is why you have not considered having an attorney to file a Writ of Mandamus for you?
There are hundreds of people ALREADY IN USA who are being denied timely process of their citizenship because of their names have not cleared the FBI checks. They are all filing Writ of Mandamus law suits as a last resort.
We've actually been fighting this whole immigration system since May of 2001! We met while Hicham was here in the States going to school. Our I-130 was approved right off, but Hicham had an appeal on a denied asylum case that had to be dismissed before his AOS was complete. We were at the 1 1/2 year mark still waiting for the asylum case to be dismissed when Hicham's mother became very ill. When Hicham tried to come home, we found out he was barred from re-entering the US unless he had a I-601 waiver. WHY? Because while we were waiting for the asylum case to be dismissed, even though our I-130 was approved, his student visa ran out. So we had to start all over again in August of 2005. The paperwork had to go from our local office to the NVC to Casa and now it's in Rome for the final decision. Our AP wait time was a year and and two months! Hicham's actual I-601 waiver interview at Casa was the day that the bombing happened and they shut down the CO. He was on the train from Rabat when he got the call from Casa that his interview would be rescheduled and then they shut down for two months. We have now been waiting since August of this year when Rome advised they had finally received his file. We've been told that the wait time can be anywhere from 90-180 days. I have recently been hearing rumors though that Rome is six months behind.
I've gone through the birth of our son and the sudden death of my father without Hicham here. I go over to see him for 2 weeks every year. I've now been four times.
This nightmare has pushed our relationship to the very limits. There were several times that I thought we just weren't going to make it. Hicham has been tough for me when I felt like I couldn't get through this and I have been tough for him when he has doubts. I will never, ever say that I'm thankful that things have taken so long, but our relationship has now grown into something so wonderful and so strong, that I don't think would have happened had we not gone through this process. It's taught us to REALLY talk and listen to each other...because that's all we have right now.
I've seen many people offer the same advice and I think it's the BEST advice about getting through all of this is that YOU MUST FIND WAYS TO TAKE YOUR MIND OFF THE CASE. I volunteered with the Red Cross the first couple of years (before our son was born) and that really helped to pass the time. You will drive yourself to insanity if all you think, do and breath is checking on the case status and updates. I have written so many letters and made so many phone calls, and nothing and I MEAN NOTHING is going to speed up this process.
I also caution anyone considering filing the WOM or (Writ of Mandamus). You must have STRONG proof that your case was purposefully delayed by government error in order to have this work in your favor. I have read that if you do not have sufficient proof, this filing will be denied and can acutally work against you in the final outcome of your case. In all of the time that we've been going through this, I have not come across one person that has successfully gone this route. NOT to say it can't happen, but I do believe it's rare.
I truly wish everyone going through this process to have strength and a final happy reunion with their SO. rose.gif
Sigh.Still nothing on our end. Hugs for evey one in this group. Lets just make the best of what is left of this year. I spent the whole year in agony over this immigration crap. I just want to at least have one good memory of 2007. I have made it a point to TRY and just put this whole immigration thing out of my mind so that I can have some peace for the month and a half that we have left of this year. Serriously this whole process has made me into a nervous wreck. I want to be the person I used to be BEFORE we started this whole process. I feel that this year all the crying, and stress, and trying to get help took the best of me. I refuse to be in that state for what little is left of the year. Hopefully next year we can ALL start out with good news. KEEP THE FAITH!!!!!!
It has been one year and seven months since we filed, and there's no NOA2 in sight. The only touches we got were when my husband was changing his apartments. The distance and the never-ending wait was driving me to the threshold of insanity, until my husband decided to move to Pakistan and wait here until there's something called a US visa on my passport. Now he's here, Thank God, and we are getting to know what it's like to live like a husband and wife.
From our understanding of it, because my husband is "overtly religious", the DOS likes to keep sniffing around him. We are waiting for the visa, but we are together and sometimes I am able to forget we're waiting for anything. I am now scared this pre-NOA2 AP will continue forever because he's here in Pakistan and that's exactly what they wanted to do, to keep him away. However, we cannot stay here like this for a very long time - may be a few more months. Anymore than this would rip us financially and I am scared of another parting...
God Help us... and everyone else who's waiting.
