Full Version: What are my chances of doing the DCF successfully?

Hi,

I am trying to find the best way I can be with my future spouse. She lives in Hungary and I plan on going back to Hungary several times so that we may be together.

I know that I can petition for the K1 visa, but I am wondering what my chances are if I do the DCF.

Has anyone here found success in filing for the DCF?

You can't do a DCF unless you establish residentcy in Hungary. You have to live there at least 6 months.

Hi David,

DCF is for US Citizens who reside in a foreign country for at least a half year (usually people who work overseas and military) and would like to bring their spouse (not fiance) to the US.
So if you currently live in the US, go the K1 road, you can't do DCF.

I lived there for 2 years, but I have now moved back to America. Is there any way I can get my residency renewed?

US Citizen is required to be resident in the counselor district in foreign country for 6 months or more before the consulate can take the I-130 petition.

I lived there for 2 years, but I have now moved back to America. Is there any way I can get my residency renewed?
You cannot have a gap in residency, you moved back to the USA, you file the I-130 at the USCIS center that has jurisdiction over your US residence.

In our case the DCF door closed the day my husband (fiance at that time) left Germany and went back to the US.
If you are in doubt about your possibilities, contact the US embassy in Budapest, they will let you know for sure what your options are.

You'd also have to be married to do a DCF. No K visas allowed for DCF.

It's true the general rule is you have to reside in the country in question for 6 months, but you can ask the Embassy for an exemption to the 6 month rule. They might say yes. But as has been pointed out, you must be already married for go the DCF route..
