We applied to have my wife's conditions of residence removed six months ago, and last week we got a very upsetting notice saying that we would have to supply more proof by November 2, or she will be required to leave the country. I wonder if this has happened to anyone else here? I am trying fast to get more proof. The notice didn't say when we failed to send; it only provided a standard list of the sort of evidence that can be sent for lifting the condition. I am very surpised by this, since we had sent the following evidence.
Copies of her permanent residence card and of her passport with visa.
Four original letters written by U.S. citizens
Original tax return transcript of our joint 2005 tax return, followed by a copy of our New York State joint 2005 tax return.
Copy of my will, naming my wife as benificiary.
Confirmation letter from my retirement group, naming her as beneficiary when I die for my retirement benefits.
Letter from my financial advisor saying my wife will receive my mutual funds when I die (transfer on death), followed by a portfolio statement showing the same.
Am email from my employer saying my wife is the beneficiary with my life insurance provided by my employer.
Copy of our health insurance card showing joint coverage.
Several recent statements showing joint checking accounts at our credit union.
Some recent copies of joint invoices for utilities where we live.
Pictures of the two of us at various places, including before the State of Liberty, the CN tower in Toronto, and before the Golden Gate bridge.
Original itineraries and boarding passes for various trips together in the U.S. and one abroad.
Original letters sent to the two of us at our home address.
I wonder what other people think?

I would resend everything, and include 2006 joint tax return. Also evidence of living together, things addressed to both and each at same address, things like holiday cards addressed to same address, state ID cards with same address etc.., most of the things you list show doing things together, not living together.

They should interview before deporting.

I always believe in 'More is better' so send as much documentation as you can.

Look at the instructions -- one of the five categories listed is "Lease or mortgage contracts showing joint occupancy and/or ownership of your communal residence." I don't see anything along those lines. If your spouse is not on the lease or mortgage/deed, you might want to explain why. Other than kids, I think that's the most significant category of evidence.

Isn't there also something about covering the period between your marriage and the date of filing? It sounds like you only included fairly recent things and nothing from all the way back to the start of your marriage.

I would agree that you should send something that shows you share a residence, such as mortgage or lease documents.

After reading your list of attachments, I am quite surprised that they are asking for more proof of relationship. You have provided lots of items that would indicate you are a bona fide couple.

I agree with others they are probably wanting a lease or mortgage. If you live with relatives you could have them write a letter and have it notarized, if you don't have a lease, but pay rent you could send copies of your monthly rent cashed checks.

Excellent point about relatives you might be living with, although make sure it is a sworn affidavit and not just a notarized letter.

I don't mean to go off topic here but are you planning on kicking the bucket soon? You submitted a lot of evidence showing your wife being the beneficiary when you pass. Now, it may just be me, but if I were an USCIS officer I would be a little weary also. What you submitted could be seen as a marriage for financial benefit.

If that's the case then none of us should have joint assets or beneficiaries to anything because it could be seen that way - but USCIS generally sees that as strong proof that the relationship is bona fide.

Hmmm... I'm not gonna be able to give much information. I am feeling your frustration..All I can say is I am stumped as to why you would get such a notice. Based on what you listed for evidence, our list is almost the same but we do have a bit more extra items sent. Our evidence is at least 2 inches thick I had to send a box this is due to the historical bank statements showing even from 4 years prior to when we got married. But anyway, this really makes me worry what can be the reason and it might happen to us too. Makes me want to ask...What else do we really need to send in order to prove a married relationship? Maybe a video of what we do in our private bedroom? Its silly but thats what I am gonna send if this happens to me... I am being silly now but... hey who's being silly...I just can't believe this happens...unbelievable!

Maybe they just lost your packet of evidence. Did you include a cover letter listing the evidence included? What you sent looked good to me.

James, how would one go about getting a sworn affidavit? I need my parents to write a letter because my husband and I lived with them for awhile in between moves, and I guess I don't know what a sworn affidavit is. I don't mean to sound ignorant, but what's the difference between a notarized letter and a sworn affidavit?

we didnt know about sworn affidevit so in reply to request for evidence we sent a signed lease form, that my husband's grandma signed as owner of property we live in now. i hope it works as i didnt hear anything yet.
