Dear All,
I need your advice. My status is Permanent Resident and currently my citizenship is under process (recently fingerprinting done).
1) Is it advisable to file I-130 for spouse based on GC or should I wait till citizenship (waiting period for citizenship is approx. 7-months).
2) How much time (means postal or by contacting immigration officer in person/ by mail) I will save if I do it after citizenship.
Thanks.

I suggest you put in the I-130 now with the GC; once your citizenship is approved, let the USCIS know that you are now a citizen and send a copy of your naturalization certificate to them. By the time your citizenship comes through, the I-130 may be current (priority date) for spouse of USC. Good luck with your N-400 good.gif

The process is much faster if you wait for your citizenship than peitioning with your GC. I suggest you start gathering your documents for your I-130, so when you get your Naturalization Certificate you can send them your I-130 application right away.

Petitioning a spouse varies from one country to another, I will suggest that you visit the Marriage Based Forums for CR1/ IR1 to get more information. There are a lot of information on there that can help you with your process. You can also check the timelines of CR1/ IR1 applicants specific for your country, so you will get a better picture how long the process will take.

Good luck on your citizenship. good.gif

Before you submit while you are still a LPR and not a USC yet I'd check a bit more on what's best.
I had a friend I was helping with the same trip and was informed by USCIS there could be problem changing "in the middle of the stream".
Don't know if USCIS gave the correct advice tho.
Maybe someone else has gone thru the process and will jump in!

hi

its tough at times to changes the status of your application. its better you get citizenship and then ...just go for the IR / CR visa. Start gathering all documents, forms... fill them out... the feees... so as soon as you get your Residency.. next day yu apply for your loved one
