Hi everyone,

I got my PR (through my USC spouse) this summer and the conditions are to be removed in 2009. My company recently approached me with an opportunity to work in the UK, and as tempting as the opportunity is, I am trying to make the best decision in regards to my status in the U.S.

What is the recommended path to work overseas and not lose my US residency? Can I request to remove conditions while living in the UK since I'd be living there next year if I decided to move?

In order to retain your legal permanent resident status, you have to remain a resident of the United States. One can stay for extended periods outside the country provided you have the proper re-entry permits, but you have to prove that your primary residence is still in the USA (home ownership, etc).

This is what the USCIS website has to say:

QUOTE
You may be found to have abandoned your permanent resident status if you:

* Move to another country intending to live there permanently.
* Remain outside of the US for more than one year without obtaining a reentry permit or returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.
* Remain outside of the US for more than two years after issuance of a reentry permit without obtaining a returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.
* Fail to file income tax returns while living outside of the US for any period.
* Declare yourself a “nonimmigrant” on your tax returns.

Would you be staying there full-time? What if you keep your house here, receive your salary here and travel to the UK for a few weeks at a time?
