Hi Guys i just thought I would throw this concern out there as im hoping this will not cause my fiance and I any issues with our K1 Visa approval. My fiance went to the UK on his passport in 2002 and he stayed there until 2005. Was in England for 3 months and then the rest was spent in Scotland. He says he filed for assylum and while that was being waited upon the goverment gave him some documentation for attending school and for getting apartment. However the assylum never went through and he had to return to Jamaica. Please tell me what you think. Its not like he has any criminal records or[color="#4B0082"][/color] anything. Help!!

I've heard that it does not affect the K1 process since he didn't overstay his visa in the U.S. You can verify this with a lawyer - but I've read cases where people have done the same thing and still received the visa.
However, I suggest always telling the truth....especially since he'll need to put that down on his G-325A.

As far as I know, the US doesn't care about overstays in any other countries - only things that would make you inadmissable in our country, which an overstay in the UK wouldn't do.

Yeah, that's my understanding too. As long as no US immigration laws were violated I'm sure you'll be fine.
