I hit 100 days since NOA1 today and still no sign of that elusive light at the end of this very long tunnel.
oh well it friday

and that means chinese take out, ben and jerry's cookie dough ice cream (all fellow UK-ers with a similar need to console one's self, Ben and Jerry's is Ł1.89 a carton in morrisons) and a bottle of zinfandel! Going to watch Pirates of the Carrebean too....makes me smile (I like pirates!..at least the romantic idea of a pirate!)
We will all get there in the end......just the end seems oh so long long away!

Just saw the USCIS update on form processing,
As of October 19, 2007, USCIS has completed initial data entry and issued receipt notices for applications and petitions received on or before the dates indicated:
California Service Center
Form Number Date Received
I-130 8/30/2007
N-400 8/02/2007
All Other Forms 9/29/2007
I just got off the phone with USCIS and they claim that I-129f forms are included in the the "All Other Forms" catagory. OK then, any day now. Also I asked about the reports that some October filers are getting thier NOA1's already and the woman assured me that regardless of when the NOA1 is received by the petitioner all september filers are "in front of" october filers, just like the august filers are ahead of us and so on and so on. The forms are processed in the order they are recieved at the office.
So, we all just gotta hang in there.
Be sure to update your timeline once you recieve your notice.

Well, that date of "All Other Forms 9/29/2007" should make me feel better, but if I filed on the 26th does that mean I should have my NOA1 already? And what does it mean if I don't?
And you'd think the government would jump on the chance to cash a check and get some money, but our check has been sitting there for quite awhile. That's the part that puzzles me more than not having the NOA1 actually. Why isn't the check cashed yet?

My thought is that the receipting backlog actually means that your packet has been received at the service center, but they have not actually removed your file from the envelope yet and started putting it into their system. So, they have not cashed your check yet because they have not opened a file for you yet. Once they open your packet and move the stuff around and enter it into their computer systems, which probably generate your case number, then they will cash the check and issue the NOA1. The NOA1 is really just their way of telling you that you now have a case number and are entered into the computers now. In my case, the check showing up at my bank and being cashed only beat the hardcopy NOA1 by 3 days.

Is it normal? I would say Yes, although it shouldnt be. There are others who sent theirs in before you and still dont have their NOA1. Moxcamel did some number crunching, and if I remember correctly, you should start seeing something at the 39-43 day mark. So you are probably about 2-3 weeks from getting it.
The only explanation that I have for some of the October filers getting theirs already from CSC is because they have contract employees who do the inital data entry which in turn generates the case # and NOA1. They were supposed to be hiring more contractors, and a new guy might have grabbed the wrong stack of files.

I'm at the 39 day mark today, so if the data holds I expect to see NOA1 this week. However, we should have seen more September filers receive NOA1 by now, and we're just not seeing it. So I don't know what to say about that.
What I'd suggest at this point is that all filers who filed before September 29th, who have not received NOA1, follow the
guidance given by the CIS ombudsman in their Q&A:2. Posted Receipting Times – USCIS posts processing dates for which applications are now being receipted. However, these seem to be incorrect because customers who filed well before these dates still do not have receipts. Moreover, applications received after the posted dates have been sent receipt notices. Can you explain why?
* Response: We understand USCIS is receipting the majority of cases according to the weekly “Receipting Update,” found at www.uscis.gov. If you have not received your receipt by the date indicated on the “Receipting Update,” please send an email to the Ombudsman at cisombudsman.publicaffairs@dhs.gov. Note that if you send an email on this or any issue to the Ombudsman, please be aware that we do not adjudicate cases. You will still need to follow USCIS instructions to address your case. In addition, if you want the Ombudsman to research your particular situation, please submit a case problem by using Form 7001, available at www.dhs.gov/cisombudsman.

We didn't apply for expedited processing, nor are either of us in the military.
We did send in over 75 pages of evidence, including 6 months' worth of phone records, 15-20 pictures taken over the last three years and e-mails between us and between me and his parents. Also, About 10-15 boarding passes.

Thanks for posting, wind, glad to hear from someone who filed so close to the beginning of the month. I agree with you, it's as if they set aside our files and just moved on to October. But while I'm frustrated and a bit anxious, I am at least hopeful that there's a rational explanation for this, and that we'll still be processed in the order we were received. It could be that they streamlined some internal process at the end of September, and we're just kinda "kinks" in the system that they'll eventually work out. Sure would be nice if they'd provide some transparency to ease our mind, but that's a whole 'nuther ball 'o wax.
I still am recommending that September filers who haven't received NOA1 yet send an email to the CIS ombudsman. You can read
my original post here. I think the sooner this is done, and the more filers that do it, the greater the pressure we can put on USCIS to sit up and take notice that there are a lot of filers who are sitting in limbo, wondering if their petitions have even been received.

I just wanted to pass on that our NOA1 was sent from the VSC on 2 October. Our packet was sent 17 September. I would have posted sooner, but I've been in Thailand all this time enjoying my fiancee and her parents, and have not had too much time on the computer!

Hi September filers,
I filed in October with VSC and have received my NOA1 etc already. I wanted to lend a few words that may put you at ease a bit. Although the NOA1 notice date matched the day the petition was entered in the system, the receipt date in the top corner of the NOA1 hardcopy matched the date the USPS had posted as the delivered date. This was about 3 days earlier than the notice date. This doesn't say much except that hopefully in your cases, they will be entered with the receipt date that they were actually received in Sept, and processed in that order.
I know I would be at my wits end though, if I didn't even see the check cashed. I'm sorry.

Has anyone else called USCIS, as per the USCIS Ombudsman's recommendation,
5. Wait Times - How long should someone wait to receive a receipt for an application filed this summer before inquiring about it? Should an application be re-filed?
Response: We suggest that you review the weekly “Receipting Update” posted on www.uscis.gov, which has the receipting dates for each application type. If your application was filed before the date posted, go ahead and call USCIS customer service (1-800-375-5283) and email our office at cisombudsman.publicaffairs@dhs.gov.
and asked about their case? If USCIS says they have receipted all cases up to 9/29/07 we all should have received our NOA1's and had our checks cashed by now.

I did. And if you follow the phone prompts (can't remember the sequence off the top of my head), you're even lead down a series of prompts that culminates with something like "if you've waited longer than 4 weeks for notification of receipt, press..."
When I talked to the (very polite) lady, she gave me the line that you have to wait 90 days now. When I pointed out that their website recommends calling after the receipting date, and that their very own phone system says 4 weeks, she stuck to the line that it's 90 days. Calling them at this point is a brick wall.

For anyone that cares to try, the sequence was 1,2,2,6,2,2,1. 1-800-375-5283. (This is NOT the RFE trick, but I think it gets you to the same place.) The second to the last prompt says something like "If you mailed your case more than 4 weeks ago, please press 1." That option will give you a customer service rep.
The customer service rep will ask you a few questions, and once he/she asks "did you file before July 1st?" the gig is over. They'll then tell you that they need at least 90 days, and that there's nothing else they can tell you. I've tried 3 different times, and even one lady who was one of the most polite people I've ever spoken to in a customer service role said she couldn't help. I'd be interested to hear if anyone else is able to get past that hurdle.
Part of me wants to say "yes, I filed before July 1st" just to see what happens next.

I think the sooner this is done, and the more filers that do it, the greater the pressure we can put on USCIS to sit up and take notice that there are a lot of filers who are sitting in limbo, wondering if their petitions have even been received.
moxcamel, I sent an email to them. As you said, hopefully they will begin to notice us if many of us send emails.

Just saw my check got cashed yesterday! Can't see any 13 digit number starting with 3 letters though. Guess i have to wait for the notice.
There was a stamp that said Oct 21, 2007 on the back but no other non-bank numbers.
Hopefully this is the start of a trend!

Congrats! Finally a bit of good news. I'm always checking here hoping that one of us has heard something. I hope the rest of us will start seeing this soon.
