Hello all,

My spouse is wanting to travel back to his country for a visit. Is it true that if you have the I-797C and you have a CONNECTING flight in another country, you need a transit visa???

Any comments or advise are appreciated!

Thanks.

You only need the I-797C (and the expired green card) to get back into the US. Presumably, your spouse would only need his passport to travel to other countries, although whether he would need a visa to enter that country would depend on the country and where your spouse is from.

Having a green-card in many cases does not prevent the need for a transit visa if the person needed one before getting a green-card.

What country is your spouse from? Your profile lacks details that can help answer your question.

Please fill in your profile with details like foreign country, or at least do a timeline. timeline.gif http://www.visajourney.com/timeline/profile.php?id=9619

Each country has their own requirements. Sometimes you require a transit visa and sometimes not. Check with the Embassy of the country where he is connecting flights ...

My huband is from Morocco. He currently has the I-797C (Notice of Action) One year extension letter for his now expired green card. When we look at the US Embassy for London, it states you do not need a Transit VISA if you have an I-797 but doesn't say you don't need it if you have an I-797C.

Any advise or help from anyone is appreciated.
