Full Version: Going overseas with a K3

Hi All,

My wife holds a K3 and has been in the states for almost two months. She recently had to go back home for some work related stuff. We've already filed for AOS/EAD and are awaiting biometrics.

When she was leaving, the lady at the Delta check-in counter took her I-94. Now when my wife comes back will she get a new I-94 with a new date stamp? Will it be the same as the original I-94 date?

And also, our POE (JFK) has two lines when you come from an international flight. Visa Holders vs. USC/GC holders. When we arrived couple of months ago, we came through the USC/GC holder line and that process literally took just a minute. Will she be able to come through the same line, or should she go through the visa holders line. I only ask because K-3 is a non-immigrant visa.

She should get a new I-94 with a new date. Technically, she should go through the visa holders line. If you had no trouble at all in the other line before, I would think it would be fine again at the same airport. There should be someone around to ask before you get in line though. Also, she doesn't have to have it, but it would be good to bring the NOA1 for the I-485 just as back up. smile.gif
