Hi Everyone, I married a woman from Mombasa. We have not filed our K-3 due to my fear of not being able to prove support. I did not work in 2005 or 2006. In 2007 I'll make about $25,000. Will the no income in 2005 and 2006 kill my chances of proving support? Does the consular require my spouse to bring I-864 form for her visa interview? Thank you for your response.

For a K3 visa interview, the foreign spouse should bring the I-134 form unless Mombasa has a specific requirement for the I-864 instead. Your current income is sufficient, provided it is adequately documented. An employer letter and recent pay stubs will do. You'll also need to indicate the reason you were not required to file tax returns for prior years. No income is reason enough.
