Full Version: can we go to USA and apply for visa from there

Does anyone know if we can travel to America before our son files for a visa for us. He has decided he will be able to get Citizenship to sponsor us but can we do the paperwork and interview while there on the VWP(90 days) It would be better for us that way than over here in England as he and his wife could help us with the documents etc or would it cause problems

You cannot use the VWP to immigrate. You can come for a visit and complete paperwork while you are here. You will have to return home and wait to complete the process and interview.

Your son will need to file an I-130 for each of you.... this can be done while you are visiting the US, but you will have to return before your VWP (90 days) expires... you then have to do all the paperwork and interview and medicals from the UK... it will take about 1 year from when your son files the I-130's for you to get the IR-5 visa to immigrate to the US....

The only way for you to be able to adjust your status from a VWP is if you are already in the US on vacation and you then decide to stay.... your son could then file the I-130 and AOS together and that would allow you to remain here while it was being processed... the key if what your intent was at the time of your entry to the US... if you were to arrive in the US on a VWP and you have sold up your home and have no job in the UK, even if you were not asked at the POE you could be asked to prove you still had your home etc. in the UK when you go for the AOS interview... also you would not be able to leave the US until you had a greencard... so this can cause problems with sorting things out in the UK...
