Full Version: Spousal I-130 petition inquiry

I am a green card holder. I filed an I-130 petitioning my wife in the Philippines last July 2005. I know these have been asked a million of times by people of similar situation but I wanna know:
1.) How long really is the waiting period for the majority of applicants? Is it more or less 3 years or is it more or less 5 years of waiting? The current processing date in the USCIS website has not been moving since December 2006 or January 2007 for I-130 permanent resident petition for alien relative. They are still processing January 2005 applicants!

Before, in my NOA online, they indicated that it will take them 900-999 days to process, then on my next case status update, they took the projected days off the notice and wrote that my case was transferred from Nebraska to California Center. Speaking of California center, to make matters worse, I read somewhere here on this website that their system are down as of the moment? That means all files after January 2005 cannot be processed which is the reason why the processing time has not move since?

2.) If the current processing date in USCIS for I-130 (permanent resident petitioning spouse or children) is January 2005, and the visa bulletin in the NVC current processing date is way lagging behind (October 2002), does this mean that I-130 filed from 2003 hasn't had any case number and visa yet for their spouse to come over the US? And that those 2003-2004 filers approved by USCIS also has to wait again from NVC's side of processing?

3.) Finally, this I still have a hard time understanding, how come people I know (and I mean lots of them, most are my co-workers) who are H1B visas who petitioned their families (spouse and kids) got approved way faster and sooner than us who are already permanent residents? It only takes them months of waiting, others even just weeks. Considering green card holders have more secure history backgrounds if the USA's concern is security and safety in the country. Then they do the same thing once they're here in the US, they adjust their status to a permanent resident and after just months of waiting, they are already green card holders. And yes they're already together with their families.

Please help enlighten me on this frustrating matter. Any information is highly appreciated. Thank you.

Visa numbers are available for people who filed in your catagory (2A) with a receipt date of June 01 2002... so you have a long wait ahead...

I have the same problem like you and it is very sad. I am a green card holder too, i filed an I-130 for my husband since August 2005. My case was transfer to california center.
Nothing is happening at that center, i wander why we were sent there. I just wanted to let you know that you are not alone, i am really tired of all this. the painfull part of this whole thing is that they wouldn't give my husband visa to at least come see us for awhile while his caes is pending.

Please keep me infromed if u hear anything. Take care

It will be a lot faster if you become a US citizen. I know it's a personal choice but this will cut your wait time tremendously.

As for the other people with H1B visas, they're in a total different situation. Their family members will be getting different visas but they're not for permanent residency which means they will have to leave the US once they expire. That's why it will take longer to process the I-130 you've submitted for your wife, because once she arrives in the States she will stay here indefinitely.

But again, this will all move up the ladder a lot faster if you become a US citizen.
