Full Version: Well rats! I'm getting a checklist for items missed

So I just called NVC and listened to the recorded message:

On August 20th we mailed you a letter as we found information missing or incomplete on your financial evidence - mailed a checklist letter on august 20th for correction, please return this information to the NVC in Portsmouth New Hampshire.

Sooo I call and speak with someone and she says we have missed question 15 - Country of Domicile and they say my income for 2004, 2005 and 2006 does not match my U.S. tax return (I entered zero for all three years). I have tax transcripts, can anyone shed some light on which line or figure they are looking for? She said adjusted gross income, I do not see this (I have only foreign income for the three years btw - which I included in my return but the net result was of course zero because of the foreign tax credit).

Also, she said we failed to answer question 15 - country of domicile. I actually don't think we failed to answer, I think we left in the wrong answer!

I had decided to answer U.S. and sent documentation to support it. In looking at the copy of the form I have, it looks like I left Canada in there - oops. At least I hope that is all they want - I hope they aren't requesting further proof of domicile.

So I hope someone here will have an answer to the tax question, thanks!

Which tax form did you file? 1040? 1040A? 1040EZ? (On the 1040, adjusted gross income is line 35)

Hi,

I used the 1040 - I see the adjusted gross income on line 37 as zero (which is what I entered on the I-864):

Subtract line 36 from line 22. This is your adjusted gross income > 37 0.00

My foreign income was subtracted out per 2555EZ on line 21

I called them back and she asked her supervisor and she told her to tell me to send my Canadian tax returns - I really wish we had been able to DCF.

Anyone? hellloooo

Did anyone who only had Canadian income put anything rather than zero for the last 3 tax years? Did I get it wrong? Any help is much appreciated.

I only had Canadian income. So your adjusted gross goes to zero after the foreign tax credit. I just sent them the tax transcripts and then I put down my Canadian GROSS income, less exchange on the I-864, I highlighted those amounts on the transcripts. I also sent my Canadian returns. It worked for me, they seem to know how to deal with it. However, I got it all shoved back at me at the interview time. They said they dont want to see anything Canadian. I told my wife to crunch down.

Thanks very much for your reply, the woman actually said to me, send in your Canadian returns and I'm saying yes, sure - but thinking - no that can't be right?

Well now I know so I will change those figures to my Canadian income and I will send them copies of my Canadian tax returns and I have just told my Husband he can expect them to shove them all back at the interview.

Line 35 is your adjusted gross income on the 1040. Line 41 is taxable income. They want to see your income prior to itemized deductions (includes foreign income).

I was confused about the 'Line 35' - however I just looked back at my 2004 return, they actually changed Adj Gross Income to line 37 for 2006 anyway, so I see what you mean now.

I haven't had an RFE/checklist up to this point, so I guess I will have to wait to receive it in the mail to see exactly what they want me to send.

I suspect the domicile issue will be the thing to prove. Will send them evidence that we have sold our house, have a place to live, have a bank account in the u.s. etc etc. I thought I had proven this but not good enough I guess.
