I called CSC, DOS and NVC today. CSC pretty much confirmed they wait for a batch of applications to pile up and then send them in one shipment. It is not based on timing, but instead quantity.

Why would they do this? Having been involved in corporate cost savings programs, one can look really good saving millions of dollars a year. Consider this.

I'm not sure how many applications are approved and shipped from CSC to NVC in New Hampshire. Let's say it is one million. If they save $1 in shipping per application, they just saved the CSC $1 million. Just think how good the Director will look now. I'm sure he/she will receive a fat bonus check. Sadly at our expense -- time with our families and significant others.

So if CSC is slow approving applications, they will be slow shipping to the NVC. Wow.

I'm so ticked, I'll stop while I'm ahead.

why are some people getting approved so much faster than others? I have seen march people and april people (like myself) not yet approved... yet I see people in July and August (1 person) already getting approved for the I-130... crying.gif crying.gif crying.gif now that is NOT FAIR... so just because we sent our application in when they @#(*(% up their system, it means we have to wait much longer? (during the months of march - may, they didn't do crap)...

Why don't we all get to gether and draft a petition and send to all the senetors?

Guys just sitting and complaining is not going to help our cases. If we all complain together it has more power.

Well, once your paperwork gets out of CSC's hands things move fast as heck! Our paperwork got to NVC on September 11th and I just found out that it was forwarded to the embassy in Peru on September 13th. My God! I don't see how NVC can be so freaking efficient while CSC is the epitome of inefficiency. I guess it's all part of the process though. I keep telling myself that this process will make our relationship much stronger and I really believe that.

You know that was exactly what I suspected back when we were waiting but didn't have any idea if it was true or not. This would then make sense why we should "allow 30 days" for like every single mailing. Probably they save up until they have a full load or send it every 30 days. We are all just money to them, not people. But even then, they are too dumb to give us an opportunity to pay more to have things done in a timely and/or fair fashion. All you can do is just shake your head at these people and suffer through it.

And yes, as soon as NVC got our approved I-129F it was right on it's way to the embassy in Ukraine. And furthermore, within a couple days I received a notice in the mail with this information. It actually arrived and in a timely fashion. Unforunately, I can't say the same about our approvals from CSC....they never came at all.

Sorry, I have been off for awhile. You know, I am not sure when my husband received the NOA2's but we did get them in the mail.

We still have had nothing from the NVC but my husband has not called them. I have to advise them that I have changed my address here in Canada.

Will just brought the NOA2's with him on a visit and the I-130 states what someone has mentioned near the beginning of this thread.....The petition indicates that the person for whom you are petitioning is in the US and will apply for Adjustment of status. He or she should contact the local INS office to obtain Form I-485, Application for Permanent Residence.

If the person for whom you are petitioning decides to apply for a visa outside the US based on this petition, the petitioner should file Form I-824, Application for Action on an Approved Application or Petition, with this office to request that we send the petition to the Department of State National Visa Center.

What do we do with this? Do we just ignore it and complete the I-485 when I get my Visa and move to the US or should we be completing the I-824 now?

Hi Kim,
The answer to your question depends on your future visa plans... If you would like pursue K3, which technically is a non-immigrant visa, then you can enter the US on a two-year multiple entry K3 visa and file your AOS(485) here in the US but if you would like to pursue CR1/IR1 then you will have to file I-824 to get your I130 going again.. to NVC and then to one of the embassies in Canada...Sorry if u already knew this but I thought this is what you were looking for..

In my PERSONAL opinion, keeping in mind the overall visa/fees/embassy structure in YOUR case.. meaning since you are from Canada and can travel to US frequently.. It may be easier for you to get a K3 visa and then go back for your IR1/CR1 interview (hence avoiding the costly $1010 AOS fees)... provided you file the I-824 to continue the processing of your I130.. but please do check with some other VJ pros here .. I may be missing something.. and I should also mention that you should check on the processing timeline for I-824 and I believe the filing fee for I-824 is some $250 or so.. unless they changed it recently..

Life just sucks and so does the system to get a VISA for your legit spouse. Why do they make us suffer so much, why do they do this to all of us. crying.gif

I came to India hoping that while I am here the papers will arrive here and I can help my wife with all the running around and be there for the interview...but everything is getting so much delayed. We got approved from USCIS on August 15th. I spoke with NVC a few weeks back and they said that they are mailing out a letter to my lawyer for Affidavit of Support and Green Card Fees. My lawyer still has not received anything in the mail... sad.gif Why does this mail thing take so long with the Government. When I mail something to someone they receive it within 4 business days max. Then why is it taking them over 2 weeks? WTF huh.gif

The wait is brutal. My wife is in her 6th month of pregnancy and I really want her to deliver in the States. I hope by some miracle her interview happens in October. innocent.gif

Anyone have any ideas for realistic time frame I am looking at for the interview date?

Question? Did u get a touch online on ur case on the 17th when it arrived NVC? I know mine has been sitting in the mailroom at CSC since 4Sept (told that by rep) and I got a touch on the 17th. Wondering if that was it leaving CSC or arriving at NVC.

i can feel your pain Jas. it must be doubly hard for you since your wife is pregnant. i think if your I-129 was approved it would have been more beneficial for you. it is hard to project the time frame for the interview but for i-129 it is usually anywhere from 2 to 3 months. i still don't understand why your I-129 didn't get approved. even though we all now that the CR is a better visa but since you want your baby to be born here I-129 would have been super. all i can say is I will pray for you.

I was wondering the same thing. Did I see the last of the touches when it was approved last week ,or will there be another one once it actually leaves the control of the CSC and is on it's way to the NVC. It looks like the NVC only holds them for processing for a week or so, and then ships them off to the appropriate embassy.

Jas, bad news is that for an I130 to complete processing at NVC takes anywhere from 4-6 months. If you were following James' Shortcuts you can shave that down to 3 months ( I know you are out of the country and you can't use the shortcuts). Don't know about the wait time for a CR1 interview at your consulate. If your I129F is approved, it might get to India sooner than the already approved I130. You might still get a K3 interview before the I130 case is finished at NVC. Good luck!

So,he was told that we have to wait at least 90 days,before we call again.
I am kinda freaked out. crying.gif

Kalina, when you check with NVC on your forms are you talking to a person and asking about both forms?

Sorry, Kalina, Zolanden, and everyone else waiting on these slow government agencies still. I think no matter what they tell you, just keep calling every single day! And if someone tells you something that leaves you feeling hopeless, call back and talk to another person. Because they will all tell you different things. Eventually you will get ahold of the right person that can really help you or provide real information and not just give you the canned answers.

What I can tell you is that after waiting so long, something should happen any day now. It is smooth sailing after that....things move much quicker. So don't lose hope!

kalina and zolanden.... i know how you feel. i was freaking out too. it took them 31 days for my petition to be forwarded. just give CSC a call using the RFE trick... if you haven't done that. other than that.. all you can do is wait. but i am positive everything is ok with your case.... they are just LAZY.

Hey everybody that's waiting - STAY POSITIVE. I already know that it will be 4 weeks ( if I'm lucky ) to get out of the CSC.. It wasn't until I hit the 180 day mark did I wind up calling the CSC. I got approval the next day. I wouldn't call every day , they know who calls , and unless you have a real problem like Kalina has ,you're not going to speed things up but only agitate them.

I just called NVC and they received and forwared my petition to Mumbai Consulate today (Sept 19th). Guy even gave me "BMB" number over the phone.

I am so happy. kicking.gif

What should I mention when I email Mumbai Consulate?
Should I just tell them that I will be sending in packet 3 or wait for a reply first?
Email i have for them is: MUMBAIIV@state.gov. Can someone confirm that?

PDD, Yes the email is correct. However, I would call DOS first to get an update whether your case has been opened by Mumbai consulate. And then send an email to Mumbai Consulate to confirm that it is OK to send in Packet3.

yeah i had touched on the sept 17th and that day also they received in NVC , i just called today and they say it will going to be send in manila embassy today.

Ive got to touched this sept 14th , i called them that day but still not there then sept 17th , i called them sept.18 they received it sept 17 and now sept 19 they going to send it to manila embassy so i guess only 1 or 2 days stay in nvc .

For the people who know....

Why does for some people the I129 get approved along with the I130 and for some people only the I130? What is the reason for that?

I don't know the answer Jas S. But according to me you have to contact CSC and try to expedite your I 129 F. I think that I 130 will take long time at NVC. Wish you luck and hope that you will succeed in bringing your wife to USA before giving birth.

I emailed Mumbai Consulate yesterday and they have not replied as yet. I guess I'll have to wait for Packet3 in the mail mad.gif

It's about freakin' time! You were well overdue. Expect about a month wait for NVC to get it, but from then on, the process will fly by! good.gif

Hey guys... today I called NVC again just as I did everyday since August 23, I heard the same new information again.
"We haven't gotten your file yet, allow 3 to 4 weeks"...

I replied, "But, but It's already been 4 weeks".
Nice NVC Lady: Well it can take anywhere from 3 to 4 weeks to 90 days. Call back after 90 days.

I hung up and
I continued to follow my routine of calling CSC using the RFE trick.

Just my luck, the Same lady from yesterday picked it up. I can tell she is Indian by her accent smile.gif.

She took my case number and name. And after sternly telling me that I shouldn't be calling everyday to check the status. She told me my case left to NVC yesterday at 6.00pm.

So I said: Cool, since they already told me they haven't got it today, I will call em tommorrow to see if they got it.

She: NO, NO, wait 2 to 3 weeks because NVC gets thousands of cases from all the Service centers and it takes them 2 to 3 weeks to enter your case into their system and assign a number.


I : Ok, ok, I won't call tommorrow.

and then I said you are sure it left CSC yesterday. and She said, Yes it left yesterday at 6pm.

I said, Thank you, Thank you so much. and I hung up.


I wonder if NVC will give me the case number tommorrow when I call them. wink.gif
