We scheduled our medical for next Thursday. The consulate still hasn't received our I-129F yet, but they said if we don't have it by then we will be fine as long as we bring the exact case number.

my case has not been sent to the embassy yet sad.gif...how long usually from NVC to embassy?? They told me 2-4 weeks....also, Amman embassy replied to my email...they are currently in December interview dates...i want to cry sad.gif

I just called NVC...they've got my stuff now good.gif What a relief to finally know that my paperwork is out of CSC's hands!!!! 21 days between NOA2 and NVC receipt for me...sounds about the norm these days

I think I'm laughing only at the irony. I will be stuck there too. It's like a horror story. Just when you think you killed him -- HE'S BACK... and we thought waiting for the K-3 was tough... isn't the AOS even worse?

Anyway, enjoy getting your loved one here. I think the AOS will be easier to deal with once we have our spouses at our sides.

Even though I've heard it's really tedious, I'm not too worried about the AOS. I don't even have a clue what we need to do for AOS right now because, like probably most other VJer's, I'm just excited as heck to get my sweetheart here. I'm an organization freak, so once it comes time to do the AOS I'm sure it won't be a problem.

You're exactly right about everything being easier when our spouses are with us. Once she's here and we can do everything together, the AOS will probably seem like no big deal at all.

We're almost there!

Are there other people in the same boat as me? By that I mean, you have your I130 approved but not your I129. My case is with NVC. Do you know how it will affect not having a I129 approved going into this? Thanks

Hi everybody. 30 days since our approval and NVC has not received the petition crying.gif crying.gif crying.gif This is awful. My husband call NVC and CSC every day and nothing. Our plans to be together in September are broken again. Our child will turn a year soon and it is raised without a father because of USCIS and lazy people of CSC. Nobody will give us back this time. We lose so much. I am very upset. Animals in USA are treated better than us.

Jas, your I129F can still be approved, and you still have the option of pursuing the K3 if it is. The only thing is, if the NVC processing is finished and the approved I130 case gets to the consulate/embassy, your I129F will be cancelled. But then, you will be ready to get a CR1 interview anyway, so it might not matter much. The only thing is, if you start paying the NVC bills, then get the I129F approved and go that route, you will lose that money.

I just got off the phone with NVC. They said that they mailed out a letter to my lawyer requesting the affidavit of support and visa bill information that my lawyer has to fill out and send back. They also said after they receive that info. then they will review things and send to the Embassy. What is going on? Why does my process seem completly different then all of yours. In your case it's going directly to the Embassy...

Affidavit of support is sent to NVC for a CR1. You will end up completing an I864 instead of I134. Further, there is the immigrant visa fee that you must pay for a CR1 to NVC. Go to the guides and look up the CR1/IR1 process for the details of that. Everyone else in this thread got I129F approvals too, so they are doing the K3. There is little for the NVC to do for the K3. The non-immigrant visa fee is collected at the embassy/consulate. They forward those quickly. You are headed in to the CR1 process. If you don't want a CR1, don't pay the bills, and you have to tell the NVC you are waiting for the K3, that you want the I130 sent back to USCIS to hold for the eventual AOS.

The difference in wait times for CR1 vs K3 is the difference in USCIS I130 and I129F petition processing times + NVC doing more for CR1 in more time + difference in interview waits at the consulate. That NVC time is part of why so many still go for K3 even though the difference in USCIS I130 and I129F petition processing times are not as different as they used to be. NVC time with I130 approved only can take 3-4 months.

Thank you for your reply, much appreciated. Everything is always so confusing...and there is always waiting.... wacko.gif Why does everything have to take soo long. I came to India thinking, I might be able to go to the embassy and expedite things based on her pregnancy, but I don't know now....I wonder how much longer before the embassy receives the paper work.

Any particular reason why most people got their I129 approved also and not me? huh.gif

You got your approval on same day as I did on my I130. I am also still waiting for my I129. You are not alone smile.gif Patience is virtue.. On a bright side, atleast you are with your loved one now.

It has been almost 4 weeks since we got approval from USCIS. NVC still says they have not received anything, is this usual time frame? What is the average time it takes to get from USCIS to NVC?

well when it comes to uscis.. nothing is usual or normal. they are very unpredictable. mine took over 4 weeks to get transfered from csc and there were other people who got the approval after me transfered within 14 days. so give uscis a call through RFE and asking what the heck is happening. .

It should be any day now. It seems like it's been taking between 3-4 weeks on average lately. It will definitely get there though...just part of the big waiting/patience game when it comes to CSC.

Just in case this may help someone from Ukraine or another country. The embassy in Kyiv recently set up a call center where you can ask questions and also you must make your interview appointment at this call center for K3 visas. (Of course they charge $12 for 8 minutes at this call center which is just cruel to people from Ukraine in my opinion, but I digress....) Anyway, we had tried to call a few times the last week and they had not received our case. Same thing today...hadn't recieved our case yet.

My wife moved during our visa process so we also asked a couple times about changing her address so she would receive her packet 3. They told us we don't need to do this really that we could download the same thing from the embassy website. This made me a little nervous so I had my wife ask again about changing her address (you know how you always get different answers from these people). Today, they gave her an email address for the embassy instead (you can find this on the embassy website but it is a little hard to find). Anyway, my wife emailed them with her new address and also asked about our case. They told us that they had in fact received our case and emailed her the packet 3 documents too within about 5 minutes! I was shocked to see such a quick response! This contained our welcome letter for our interview too so we just need to wait until Monday when the call center is open again to schedule our interview.

So I just wanted to share our experience in case other embassies use the same system or in particular if you are going through the Kyiv embassy on a K1/K3 visa (CR-1 I think are handled differently and scheduled through the NVC instead so this probably doesn't apply). But in short, I think the main lesson here for everyone is....be pro-active. Don't wait for responses. You need to call this people and keep checking and double-checking in every way possible if you want to get done as quickly as possible. Don't just wait for the process to do it's thing because often these systems are set up in a very inefficent manner and don't reflect where you really are in the process. You need to find the right person to tell you your status. And if you don't like what one person tells you, hang up and call back until you get someone with human emotions! I'm serious...some people just hate life in my opinion and are of no help at all. They want you to be as miserable as they are. Some people are also just flat-out idiots! Call until you find the normal person that's been around a while and really knows what's going on! Chances are it's going to help save you a lot of time, effort, and frustration!

Kalina.. give CSC a call. mine was transfered in 31 one days as well...but still u need to call and ask what is happening using the RFE trick.

I just talked to CSC and was told that my file was sitting on the transit dock since Sept 4th ready to go but give it at least 2 more wks for it to leave the bldg to go to NVC. It would seem that its sitting there ready to go they would just send it. If they are waiting for a certain number of files to be ready before they ship no wonder it takes so long to get to NVC at the speed they approve things.

yup yup! mine is sitting on some pallet as well. guy told me that it will go out in few days and call NVC in two weeks to check on it.
He also told me that they hired some contractors to do the job and they are behind on almost all cases.

They need to hire Indians. We are fast and efficient.

Now that I'm finally on to the next step ( transfir to NVC ) I'd thought I'd browse the approved March filers thread. In my horror I see Kalina still waiting to leave the death grip of the USCIS mad.gif mad.gif !! I guess I can expect mine to collect dust for another four weeks or so at the USCIS. Hey, if we can have the USCIS put all of our approved petitions on one pallet I know a long distance truck driver who will deliver them to the NVC in four days kicking.gif kicking.gif!!!

I called NVC today and they said my case was transferred just yesterday. It took a while, but atleast I know they sent it now.

My husband called CSC and they said that our case was sent to mail room as of 5 September instead of 15 August when we were approved. So the petition now is sitting at the mail room and waiting to be sent with cases approved at the beginning of September. Normally we should wait additional 3 weeks to be received at NVC crying.gif crying.gif crying.gif crying.gif crying.gif I am so upset. It is our seventh month waiting with CSC. crying.gif crying.gif crying.gif
