Full Version: Can two I-130s be filed by two family members for the same person?

I am a USC and my parents are permanent residents. I have a unmarried brother over 21 in India. My father and I both would like to file I-130 for him.

Is it possible to file two I-130s for the same person?

You need to check the timelines with USCIS for both cases. Right now it seems that it will take many, many years to get a visa either way since you would be petitioning your sibling and your parents are only LPRs.

But thinking more about it, I think the USCIS would catch both applications based on the data they enter in their system for the beneficiary.

Why don't your parents try to get US citizenship? That may make it go faster.

I don't know about filing 2 petitons for the same person by different peeps.
I do know it would be a bit faster as Mononoke said if your parents got their USC.

Processing petitions for USC parents filing in India for son is 2001.
For LPR parents 1998

For you as USC for brother is 1996.

I'm not sure but I don't think the processing dates go up on a regular monthly basis.
I "think" it depends on visa availabilty.

Doesn't hurt for you or parents to give it a shot as time flies.

Maybe someone else will know about filing 2 different petitions for the same person by different peeps.
Seems to me there shouldn't be a problem BUT that's just me.
Peeps do K3s and CR-1s which are 2 different visa by one person.
Not quite the same trip tho.

Yes, for twice the price!

The LPR parent's petition also can be upgraded to unmarried adult child of USC if and when they naturalize, which might help. Its going to be a long wait for a visa number either way.
