Full Version: Travel Within USA on expired I-94?

HI!
I am an absolute newbie here! I've really enjoyed reading the boards and have found so much information extremely valuable!
I have a question regarding travel WITHIN the USA.
My husband just recently filed for AOS and like many others, we have received no notices or info. as of yet. In the packet we sent, he also applied for the Advanced Parole....and right now there has been no movement on that.
We are scheduled to take a trip to California (from Hawaii) in Sept. and are wondering if there will be any trouble with security at the airport if they see that his I-94 has expired. He passport is valid (Germany) but his I-94 expired about 1 month ago.
As I understand it, because we are married he is allowed to remain here in the US with me, but, not able to travel OUTSIDE the USA until he gets the advanced parole...

Any insight would be GREATLY appreciated!!!

That is correct. Thus, all he's really using his passport for is ID purposes at the airport.

I haven't encountered any difficulty with air travel within the US on an expired I-94. But take along a copy of your marriage certificate and the I-797C NOA for his AOS just in case. That will show that he is here legally. If it doesn't come before you leave, bring a copy of the submission. However, I don't think there's any cause for concern. I was never asked for proof.... just for my valid passport.

It is not a problem to travel domestically with an expired I-94 card in the passport, the passport is only used for ID.
