Back in 2004, I called the USCIS 800 number and I inquired about petitioning for my wife and two kids who were under 18 at the time. I was informed by the agent I spoke with that I need to file ONE I-130 for my wife and include my kids in the same petition in the relatives section. I did that and now that my petition is approved, I was told that I had to file a seperate petition for each beneficiary (total of 3, one for wife and two other for my two kids).
I browsed this website and it seems that seperate petitions were needed for every one I needed to migrate. I am still a permenant resident and it took a long time to file for my wife. I have two more sons who are US citizens and could file for my wife long time ago ( I guess what I am trying to say is that if the intent was that we file for just my wife, either one of my US sons could have filed for my wife as their mother and it would have taken only 5 months to bring her here). We would not have had to wait over three years. The main intent was to reunite the entire family.
Talking to the immigration officer, he suggested that I file I-130 for my kids now. Also, he mentioned that I could talk to the NVC/consulate to see if they will be willing to include my kids with my wife.
My question is whether there is someone out there that went through similar situation as mine. Is it possible to include kids of a permenant resident to an approved I-130 for the spouse. Please advice what to do and whether you have gone through similar situation.
