Hi everyone,
I am Polish,subject to the INA 212(e) and want a waiver of the two-year foreign residence requirement. I am subject to the 2 rule because of the Exchange Visitor Skills List. I was in US in 2004-2005 and after one year of training came back to Poland on time. My restriction suppose to be over by this November but during these two years, but I was away from my country working in UK for 7 months so unfortunatelly this time doesn'r count. I have an American fiancee and we want to apply for K1 wisa, but first we need to get this waiver.

We were thinking about many ways for me to get to US as soon as possible, but I see that we need to get this waiver first. I was following this web:

and trying to do the first step(filling the application on line) but I am stucked, when it goes about Statement of reason. I man this sentance:
"Please write a statement demonstrating why ......... is eligible to receive a waiver of the two-year home country requirement of the exchange visitor program. The length of the statement may vary.
What should I write here?
1. Should I write that my Internship was sponsored by private sector( I have a written proof from this american agency) and not by any of Governments
2. Should I mention that I came back home on time (I have a board pass)
3. That I am going to apply for K1 visa
4. Tourist visa
5. I am subject to this restriction because of my Skills, but during my stay in US I didn't have any training and I worked as a waitress. Should I mention about it?
Can you please help me? I dont want to make any mistake.
Can I apply for a waiver when I am in Poland or my fiancee can do it for me? What is the next step after this application on line?

I would discuss this with a qualifed immigration attorney - it would be worth the cost of a phone consult to be 100% clear, and I wouldn't want to base a decision on responses from an immigration forum where people are not experienced in this issue. Good luck.
