I've been reading the K3 flowchart in the Guides Section. Wow! Thank you for this wonderful website!

I just had a question about it though. Would the flow chart change at all if the I130 has been approved, but we are going ahead with the K3 Visa? Does having an I130 approved change the procedure at all? For some reason our I130 was approved very quickly (131 days) but it seems to be held up while the K3 Visa is going through (now pending). I just didn't see the I130 mentioned in the K3 flow chart after the intial filing.

Thanks.

dearheart,

The I-130 petition plays no role in the overall K3 visa process unless and until the K3 decides to apply for adjustment of status after entering the USA. Other than being a prerequisite for submitting an I-129f petition it has nothing to do with getting the K3 visa.

The chart should probably be updated to show that the I-129f petition can now be submitted concurrently with the I-130 petition.

hi yodrak....

im just wondering... why do USCIS still require that NOA from the receipt of I130 be attached on the I129F packet? is it really that important? how important are these NOA's????? are they worth waiting for? or just go on with that concurrent filing you have mentioned?

thanks...
