Full Version: do I have to accompany my spouse?

Hi folks

I am USC by birth. I DCFed for my husband and he has a CR-1 visa now. He is ready to enter the USA. Due to some personal circumstances I may not be able to go with him or be present in USA before he enters in USA.

I was wondering:

1. is it is a requirement to be present before your spouse enters the USA?
2. if not present already, is it a requirement to accompany your spouse when he/she enters the USA?

your suggestions much appreciated.

If a domicile has not yet been established by the USC, it IS a requirement.

sorry forgot to mention that I do not maintain a US domicile
even in this case neither a requirement?

No, in this case, the USC must either preceed or accompany the beneficiary

Thanks for responding.

How are they going to know if I have a US domicile?
During the whole visa process they were not bothered about my domicile.
Are they going to check when my husband enters the USA whether I have maintained a domicile or not?

If the beneficiary is travelling alone, the questions will most likely come up at the POE with immigration. A truthful answer will preceed an entry denial. A lie may preceed a ban.
